At Dave Chappelle's Request, Netflix Removes Chappelle's Show

That was fast. The streaming service has already removed the sketch comedy series.

As quickly as Chappelle's Show surprisingly popped up on Netflix this last month, it has now been taken down. Early on Tuesday, comedian Dave Chappelle posted an Instagram video of a previously recorded stand-up set with a caption that only reads: "This is why."

This should not come as a total shock, although it is still surprising, to be sure. When Chappelle hosted Saturday Night Live earlier this month, he made a crack about how ViacomCBS licensed the show to Netflix without paying him--which assumedly was true, though the stand-up video--titled "Unforgiven"--linked above confirms it.

In the video, Chappelle says, "People think I made a lot of money from Chappelle's Show. When I left that show, I never got paid. [ViacomCBS] didn't have to pay me because I signed the contract. But is that right? I found out that these people were streaming my work and they never had to ask me or they never have to tell me. Perfectly legal 'cause I signed the contract. But is that right? I didn't think so either."

Later in the video, Chappelle compares streaming his show there with the current agreements in place as "fencing stolen goods." As of this writing, Chappelle's Show is still available to stream via CBS All Access.

Netflix has not yet made a public comment.

I don't see the issue on either side.

On the one hand, Chapelle signed a contract that dictated his payment from the Chapelle show.

On the other, Netflix wants to do future business with Chapelle, and they're doing what they can to keep him on board.

There are no heroes or villains here. Just business.

I don't know. Yeah it sucks, but if you sign a contract you signed one and you abide by the rules.

If the contract is not to your liking you renegociate for futur works, but both you and the other party profited from the conditions of the contrat on the previous work.

Those conditions being decided at the time with the current state of the artist's popularity, reach, range and so on.

If you got popular you can't go back and say it's not fair that the thing that got you popular doesn't pay as good or more than what was agreed...

@Slash_out: Yep, 100% truth there. Same goes for Taylor Swift and her back catalogue. Contracts are negotiated with CURRENT market values, not retroactively.

(...unless your legal team has the foresight to bundle in a clause for residuals, % of future gross, etc. -- see Keanu Reeves for the best example.)

@rutgo: So your point is they are bad guys so the law shouldn't apply?

That is a lame duck argument. The big bad corporation invested a lot and took all the risk to create a platform and the show with an unknown commodity, then they rewarded him with a very large contract for his success that he ran away from.

The show could easily have bombed like so many Comedy Central shows do and would he then give some of the money he was paid back? Of course not, so why the double standard.

Sh*tty longer term contracts... Everyone has signed one of those at any point of their lives.

That's why good managers renegotiate annually or bi-annually.

Once the show became a hit, with a short contract, he could have fixed the royalties issue.

Yes, the networks are not nice for taking advantage, but on the other hand, business is business. Dave should have fixed it after the first contract was up.

@mrbojangles25: This is also true -- he holds a LOT of power and control over current and future content (since he IS the content), and those past lessons learned will help him and his lawyers negotiate mutually-beneficial contracts

Netflix is handling themselves and their talent well here, and it looks good on them too. Win-win.

For those who want Dave to benefit from the old material, it's possible he gets a residual from NEW (not used) boxed sets of Chappelle Show DVD/BR discs.

I’m getting the vibe that many here won’t watch the full video. It’s a little long at 18 minutes but it’s worth a watch. I can definitely see where he’s coming from. The man is a legend and no one can dispute that he walks to the beat of his own drum.

There’s something grim about this Taylor Swift-Dave Chappelle approach of leveraging their fan base in their contract negotiations. We’re talking about a hundred millionaires pleading for public sympathy to get another few million. It’s grim.

@chriss_m: Maybe that's true of Swift-I can't recall if she writes any of her own music. But even then, grim? Maybe if one is a corporate vampire that's grim. If millions of idiots think that crap is music, why not let the dancing, lip-synching extraordinaire make her money? That whole show would've been nothing without him, wouldn't have made money without him, wouldn't be etched into our cultural memory without him.

It's also why she has so many hits, she's got real talent at writing those catchy parts of songs that just get stuck in your head. It makes up for the fact that she's only a middling-caliber vocalist at best.

@schesak: yeah, music industry news...the current state of the mainstream music industry I find equally boring. Been that way for awhile. Thankfully there's always something interesting going on, even if it isn't in the top 40. Her stuff is catchy - but so is the Village People. So was the Spice Girls. So was Bieber. Shit still makes me wanna die ;)

Despite his protestations, Chappelle did not have to sign that contract. He chose to. And regardless of whatever pay he got from it, he profited wildly from the exposure of the show - it made his career.

Stand-up and Half Baked got Chappelle to where he was able to do his own show. The show did skyrocket his notoriety but the network burned him with a predatory contract and he ultimately bailed, ending his career. His career began anew when he started doing stand up again and negotiated a smart deal with a more benevolent company. That's him making his career, Dr. Zoidberg, not the corporate drones you seem to revere

It really strikes me as either ignorant or (far more likely) insincere to suggest that the money he's making now isn't due to the writing, performance, organization and hard work that went into both his more recent Netflix specials and his Comedy Central show, but rather "he was famous, therefore he now makes money." @VANGUARD003: The executives working hundred hour weeks to support the infrastructure that allows the celebrities to jet set around the world experiencing lives we could only dream of whilst STILL making hundreds of millions of dollars also deserve their pay.

But more than that: this is about rich people deciding how rich they make each other. If you’re worth more than the contract, then don’t sign it. Don’t pretend like it’s some sort of moral crusade that the general public must be outraged over.

I thought this was going to have to do with Netflix's ever-increasing repetoire of objectionable content like "Cuties" and the like. That being said, I honestly can't believe the kind of stuff companies can legally get away with using a simple contract. Seriously, up until now, I would have never thought it possible that all it took to legally swindle someone out of earning money for their performances was their signature on paper. There should honestly be more restrictions on the sorts of things that contracts can allow because this is completely absurd.

@Warlord_Irochi: Netflix pays wholesale prices for content. People will now pay full price off of Google Play, Fandago, Apple tv, Amazon Prime Video, VUDU and Microsoft Video. Alternatively they'll just sub to HBO Max or the CBS app where they see more money directly. CBS will still get their money one way or the other.

Yeah total BS, since he can't ever profit from the show (because of his poor choices), no one should be able to watch it ever again? Unless they go out and buy the DVD's in which case he still probably doesn't make anything.

Also he is probably taking money out of his co-stars and writers pockets who did adhere to their contracts and make syndication royalties.

@CashPrizes: The reality is that those artists and co-stars if they had as big balls as Dave Chappelle would turn tail, run from the system, and make their own way.

Dave Chappelle gets to whine because he's GOTTEN screwed by people as much as if not more than anybody else.

He is the guy who's made it big, and arguably because of a lot of skill and talent, but it didn't have to end up that way.

Well that is... not intuitive, to be fair. I would've thought his contract break in S3 just bars him from profiting off S3, in addition to forfeiting pay at the time. But it voided all future royalties from his legit work in S1 and S2? Stinks I guess, though... choices.

@Lamesy: I'm not sure he was ever going to earn royalties for seasons 1 and 2. I know that at least for DVD sales, those weren't going to start til season 3 when he signed his new contract.

As I recall Dave Chapelle hit it big with that show, cashed a giant check for season 2, and then didn't feel like working anymore. Comedy Central was forced to fill in the blanks with guest hosts and shorten season 3 to practically nothing. Why Dave Chappelle should want to bring this period of his career back up is beyond me, but it's no surprise if a company that owes him nothing doesn't feel like paying him.
