Bethesda Under Investigation Over Fallout 76 Refund Policy On PC

The law firm investigating Bethesda has already received more than 200 phone calls and emails.

A law firm has launched an investigation into Bethesda Game Studios over Fallout 76, and specifically its refund policy. The Washington D.C.-area law firm, Migliaccio & Rathod, said in a blog post that it's launched an investigation into the developer for supposedly "refusing to issue refunds for PC purchasers of the game who found it to be unplayable because of its technical problems." The law firm's blog post calls Fallout 76 a "heavily glitched game."

"While minor bugs and glitches are expected with the release of most new games, Fallout 76 launched with a 56GB patch that has proven to be but a starting point for the game's problems," the firm said. "Gamers who have tried to receive a refund because of the game's myriad glitches have been unable to do so since they downloaded the game, leaving them to deal with an unplayable experience until patches bring it back to a playable state."

Many people on Reddit (via GI.biz) have reported that Bethesda acted quickly in responding to and completing their Fallout 76 refund requests. Not everyone has been so fortunate, however.

It's important to note that Migliaccio & Rathod have not taken any legal action against Bethesda, and based on their public appeal for cases from the community, it sounds like very early days for whatever this amounts to. A search through the United States court systems shows no results for any legal action being taken against Bethesda over Fallout 76.

Nicholas Migliaccio, a partner at the firm, told Motherboard that they expect to draft a class-action lawsuit against Bethesda. "We've been inundated and we're still investigating the claims, but we do intend to put together a class action lawsuit."

The law firm said it had already received more than 200 phone calls and emails about Fallout 76. Another partner at the firm, Jason Rathod, added, "The vast majority of them are--'I sought a refund and they're not issuing one to me.' The game is unplayable. We are inundated with those types of communications from people. I think people are just seeking to get their money back."

In the same interview, Rathod pointed to Aliens: Colonial Marines as an example of a successful class-action lawsuit. As you may recall, players launched a class-action suit against publisher Sega and developer Gearbox, and in the end, Sega settled for $1.25 million, according to Polygon.

Another element at play for Fallout 76 is that the digital PC edition was released exclusively through Bethesda.net, and not Steam, a platform that has a generous refund policy. Bethesda's own return policy states the following:

  • "Unopened CDs and DVDs can be returned under the guidelines of our General Returns Policy."
  • "Digital Codes and opened CDs and DVDs cannot be returned under any circumstance. No exceptions to this policy unless where prohibited by law."
  • "Please be very careful when purchasing video games at the Bethesda Store."

We've contacted Bethesda in an attempt to get more details from their side.

GameSpot's Fallout 76 review scored the game a 4/10. Reviewer Edmond Tran specifically called out the game's numerous technical issues in his review. In other less-than-great news for Fallout 76 was the recent discovery that the promised canvas bag in the $200 Collector's Edition was replaced with a nylon bag.

According to Bethesda, "millions" of people have played Fallout 76, so it appears to be successful by some measures. The developer plans to release new features, fixes, and changes for the game on a regular basis, beginning with the first major patch next week.

Looks like they are caving on the whole canvas bag thing. Saw a tweet from them that they are starting up production on the canvas bags and those that want it have to go thru steps to show they purchased the Power Armor edition to receive one. Guess their lawyers told them that it WAS false advertising and the government could involved if they don't rectify the situation, which if that had happened the fines could have been in the millions. Seems that canvas is a lot cheaper than they thought.

That guy in the video above talks so much that you get to see a hint of annoyance from his female co-host, who appears to be screaming inside. Watch about 4:12-ish, when during his long ramble, he says "where it seems like they didn't really spend a ton of time..." Watch her face. Priceless!

Why not ask people who have been playing ESO about Bethesda's "Patch" system? Every other patch breaks the game, and almost every patch locks out steam players. I've been playing for 2 years, and this is a pretty common theme. They make EA's SWTOR look like a well oiled machine at times, and that game is shit as well.

Regardless of whether or not Bethesda should refund the games, is there really any likelihood of any future lawsuits actually being successful? Can someone show some examples of major publishers actually losing a lawsuit because of their game sucking too much?

And I don't think that Aliens:Colonial Marines really counts since my understanding is that a settlement was reached before a verdict was given. As in, they didn't actually lose the lawsuit, they just chose to settle.

I realize that the company's official return policy doesn't supersede law (as is actually pointed out in the return policy), but how many cases have there actually been where a game company lost a lawsuit because their no return policy was deemed to be illegal?

Devs are simply lazy. Bethesda shows this in spades. Each platform has a primary input type. Gamepads for consoles, Mouse and Keyboard for PC. And these input archetypes are FUNDAMENTALLY different.

That means there is no easy 1 to 1 mapping from 1 type to the next. Sadly, PCs are always drawing the short stick on this. When the cursor focuses your second monitor and minimizes the game cause the dev is used to there being 1 output (a console's TV), and never assumed that could happen. When a dev (stupidly) associates START with RETURN, though it requires more effort to press when your hands are in resting position on a keyboard vs. ANY key (or not even having that gate function). When devs don't provide FOV sliders because they assume the user is sitting 10-15 feet away and viewing on a 50" TV vs. a 27" screen, 2 feet away. The platforms have fundamentally different viewing needs, inputs and concerns. So when you get a non-PC developer trying to smoosh a console port over, it's little more than a disrespectful cash grab.

Personally, the running joke that Bethesda games are buggy as hell is something they should have felt shame for. You don't gloat over a reputation like that. You don't smirk at your pathetic release-day game stability. It should be a point of contention and humiliation.

But it seems like Bethesda has turned into that skid. They are doubling down. The game is such an asset flip and reminiscent of games that came out over a decade ago. It's blatant disrespect, and I honestly hope they suffer irreparable damage from this. There's no excuse they could have lined up for an abomination like this. They simply aren't trying; they've simply given up.

@aegis_kleais: The part I don't understand is that they've been using an old and outdated engine for over a decade. How could they not know it inside and out by now and still putting out games that are known to be the most consistently bug-infested in the industry, to the point of basically being broken? Are their devs really that bad? Do they ever have QA testers?

The fact that Mr Howard refuses to update to a more appropriate engine that would probably make development easier on the team, especially on a large scale game with high resolutions and textures, just says that they either have unskilled labor and are using the "How to Make Games for Dummies" guide, or they just think they will continue to sell on brand recognition alone (which seems to have been working for their last 2 terrible games).

They've been the running joke for almost 10 years. The problem is that they most likely won't suffer any setback because their parent company is large and wealthy (Zenimax). It seems like they're investing minimal resources and selling enough on the brands' names alone. So they're probably making a decent enough amount that it doesn't ruffle any feathers up the chain. Why pay game testers when they have been using the public to beta their games for years? It's pathetic, I agree.

Whatever the case with this game, they won't be able to get away with this bs any longer. 76, imo, is the straw that broke the camels back. They have to either evolve or get left behind at this point. They've managed to seriously piss off even their most die hard fans this time and people won't fall for it again after this fiasco. All I'm saying is their next game better be a work of art!

Wish consoles had this option. Maybe even limit it a bit more to really let us dodge a bullet when needed. I own every platform to date however mostly play on my pro.. Fallout 76 us definitely a bit too rough around the edges. The bros and I are trying to make the best out of it but.... just a little too lazy attempt imo.. especially coming from one of my favorite studios. Doesnt help I prefer E.S over Fallout either..... not that ESO was a gem but its leagues above this in terms of just about every aspect.. I understand Fallout 76 is NOT and mmo.... but it's not a very good co OP game either... let alone " a normal Fallout game that you can play with your friends".

FO76 is definitely one of the most broken games I have ever played. When I attempt to play the game, I KNOW I will encounter bugs. Many bugs. Very bad bugs. Every time I do, I get fed up and rage quit and leave it for a day. The worst are the quest bugs. Every time you log into the game, there is maybe a 40% chance that all the quests you had when you left the game are still there. Usually one or more is missing. It usually goes missing when you have one more event to do to finish the quest. You then have to keep changing worlds and sometimes the quests show up. Sometimes you have to retrace your steps and go to the last location you completed part of the quest and maybe the game will suddenly remember you were doing that quest. Maybe not. I've had bugs where I can't use my weapon. I've had bugs where my ammo disappears. I've had bugs where my character will not move in any way but I can fast travel wherever I want. I've had bugs where you kill a super high level legendary mob and its body vanishes while you are walking towards it to loot it. I've had bugs where enemies won't display their health or level or type and won't take damage. I've had high level enemies I know I can't fight that have followed me clear across the map for an hour or more relentlessly shooting at me which they are not supposed to do for such a long distance. I get disconnected from the server once or twice per hour. Lag is not just common, its constant. Likely because many azzhats are using the unlimited stash exploit and carrying 50,000lb worth of stuff causing the server to bog down trying to keep track of all that junk. If you ever want to practice patience, this game is the perfect way to do it. So glad I didn't pay for this.

Bethesda is going to stretch this out until they can get some patches rolled out to point and say 'see, it's playable now'. I'm not a legal eagle though, so I don't know if that tactic would work after the calls have been made.

Bethesda won't have to. This stuff here is VERY early in the process. For a class action to go forward, first you must "certify the class," that is, get enough folk together to adequately represent EVERYONE who bought the game and suffered whatever harm you're suing for in the eyes of the court. It doesn't have to actually BE everyone, but enough of a sample that the court is satisfied that this case speaks for everyone who would want to be spoken for (you can always opt into the class after the case begins).

Once the class is certified, THEN the lawsuit begins with the depositions and subpoenas and all the stuff that we associate with lawsuits.

It can take a couple of years JUST to certify a class. THEN it can take years to actually get a case to trial. Bethesda won't have to stall at all. In just the time it takes for the process to process at normal speed, Bethesda will have time to make all the patches it wants. Probably a couple more games, too.

Folks here might get money, but it won't be soon, and it won't be all "DEATH TO BETHESDA!" It'll be way in the future, and people will be all "Oh yeah....right....Fallout 76....I remember that...that kinda sucked....but hey! 22 bucks!" and then they'll buy 22 bucks worth of booze and play whatever is popular on the PS6 and Xbox3 that day.

@darkelf83: for me it isn't that big an issue. I know Bethesda games are buggy. I've played every one back to TES:Arena. The problem here is, major bugs in a multiplayer game makes for bigger problems than bugs in a single player experience, unless it's game breaking. I still want Starfield when it comes out, and when Bethesda finishes dicking around with this garbage, TES:6. Then all the multiplayer folks can go back to playing the latest COD, I can go back to playing the games I actually want Bethesda to make.

@masterfrankgrimes: I agree I would have gotten what I deserve. Except I never bought Fallout 76. When I heard MMO, I knew what too expect. I do play ESO, and already know firsthand how Bethesda can take a great game, and turn it into crap. Case in point, there is a "special event" going on in ESO, and the group finder is broken on the EU server (I play on both EU and NA) on the first day of the event.

@masterfrankgrimes: Yes, the customer brought it thinking he/she was getting an quality product by watching ads in which Bethesda pulled an page out of EA's push on getting people to buy SimCity 2013 which was also full of bugs as well and did not play as it was designed to play. If the game was sold on the premise that it will play as it was designed to do, then I would think more than likely that no one should be entitled to an refund, but sadly this was or is not the case and refunds should be given. Personally, I am glad I waited and not brought the game for EA taught me that and never preorder even if the game looks so good. Yes, these folks should have waited but they still should be entitled to refunds.

@lonewolf1044: i disagree. people knew what this game was going to be... bethesda even put out a press release preparing people for the shit show that was soon to follow. why on earth would someone purchase this game -- at launch nonetheless -- and then expect to have my sympathy when they are disappointed by the product? these days, there are a million ways to get a preview of the games you are interested in. just watch a youtube video or wait a few days for a full review. if you decided to jump the gun and purchase the game blind, there is nobody to blame but yourself. also... this is a bethesda game. i cannot stress that enough. if you don't know what to expect with a bethesda game, that is on you :D

media is different than other products. you cannot expect to go into a movie theatre and watch a film, only to be disappointed by it and demand a refund. that makes no sense since you already consumed the content. the same applies to gaming. unless the game LITERALLY does not boot up, i wouldn't allow returns even on steam. do your research and know what you are buying. you know what? i am glad people got burned by this game because it will force them to question their decision to support bad publishers... perhaps bethesda's sales will fall and they will actually put some effort into their games before releasing them going forward. bethesda's shitty practices are finally catching up with them and that is a very good thing.

@Xristophoros: I get what you saying but you really can't speak for many people who do buy the game w/o doing thier homework. This done every time an new game comes out. Some people do not view whatever game developers practice in the same light. You watch it is going to happen again maybe or maybe not with this developer or an different developer. As said some developers hype is so good that the uninformed will fall for it. Most people may have been unaware that they would experience problems with program. Some brought the program on what Bethesda had said will be in the game and they took the developer's word for it and still went out and brought it. So in my view they should get an refund and by doing so it will send an message to Bethesda that do not swindle your customers, for if no refunds are given Bethesda benefits even if it tarnishes their reputation. This can turn into an class action lawsuit real quick if there is enough support.

This is why Bethesda isn't selling this game on Steam and didn't send out review copies so there were no reviews on launch day. They knew it was garbage. They knew Steam allows refunds and their own garbage digital distribution platform does not. They wanted to suck up as much money as possible before word got out the game was a half broken pile of trash.

Let's not kid ourselves, Bethesda knew what scores they were gonna get for this game - they aren't THAT stupid. So, shall we delay the release and make it better Todd?

No. Just don't sell it on Steam as they have a refund policy, also they have user reviews that people actually take heed of. We'll also lose 30% revenue and we can't afford that with the low long-term sales this game will get. Also, have a beta, tell everyone we will fix all the glitches they find, but then fix nothing as it's too late anyway, and we don't wanna lose those pre-orders. Then, don't let anyone review it until like a week after launch day. Don't worry about lost sales from bad reviews, we'll gimp the collectors edition to recoup some costs and there's always some nutjobs who will pay $8 for a single ingame cosmetic item. It just works.

Although a company isn't required to give you a refund, and this investigation is meaningless, this is still a dick move on Bethesda's part. They're really earning that 4 out of 10 score.
