Candy Crush Saga settles dispute with CandySwipe “amicably”

The independent developer of CandySwipe is withdrawing its opposition to King’s Candy Crush Saga after initially accusing the mobile developer of copying its game.

Back in February, after King pursued copyright claims against games with the word “candy” or “saga” in their titles, president of Runsome Apps Albert Ransom wrote an open letter that pointed out the similarities between his game, CandySwipe, and Candy Crush Saga, which was released two years after CandySwipe.

"When you attempted to register your trademark in 2012, I opposed it for 'likelihood of confusion' (which is within my legal right) given I filed for my registered trademark back in 2010 (two years before Candy Crush Saga existed),” Ransom said. “Now, after quietly battling this trademark opposition for a year, I have learned that you now want to cancel my CandySwipe trademark so that I don't have the right to use my own game's name."

Ransom alleged that King purchased the rights to a game called Candy Crusher, which allowed it to challenge his own trademark containing Candy.

However, earlier this week, Ransom replaced the open letter posted to his website with the following message:

“I am happy to announce that I have amicably resolved my dispute with King over my CandySwipe trademark and that I am withdrawing my opposition to their mark and they are withdrawing their counterclaim against mine. I have learned that they picked the CANDY CRUSH name before I released my game and that they were never trying to take my game away. Both our games can continue to coexist without confusing players.”

Back in March, The Banner Saga developer Stoic also said it reached an agreement with King, which enables both parties to protect their respective trademarks. King has since abandoned its efforts to trademark the word “candy.”

Well at least that didn't sound like he got paid a lot of money to pretend that everything is suddenly ok, and that they (King) had planned to use the name "Candy Crush" before his game was realeased.

I mean, it all sounds perfectly reasonable. Yep. Nothing to see here.

did you know that theres only 171'000 words in the Oxford dictionary?


you might think thats a lot to trademark...but it really isnt.


theres 470'000 movies on the planet. Sure 171'000 words is a lot to move around and you can play around with many variations of those 171'000 words, but if we keep trademarking stuff like this, its going to be a real issue in 500 years time. Naming stuff is almost going to be impossible. All of your precious laws we create now (which most laws are just stupid and most laws we shouldnt even be taking seriously, like marajuana laws), is going to massively affect people many years after we are gone.

@nyran125tk I doubt it will be a "real issue." 500 years from now our carbon emissions and pollutants are going to massively affect people many years after we are gone- not "precious" copyright laws.

@frenchtoastpat I'm not too sure about our carbon imprint as so much as pollutants. Do a search for

Vostok core samples and you will see that the earth natural cycles every 100k years and CO2 has been much higher before as well as the temp going down with CO2 rising. The warming has to do with wobble and orbit of the earth, melting the northern hemisphere. Not human influenced carbon imprint. While we can add to it. The sun, earths tilt, and south oceans release of methane and carbon is what you should be concerned about.

@Demonkillua Theoretically, yes. At least in the EU there have been trademarks consisting of only a single letter, (e.g. "A") that were deemed distinguishing enough in order to be granted trademark protection.


So given enough applications and assuming nobody would file an opposition against the applications, you could cover the entire alphabet.

I'm not insinuating anything, but the way this all ended sounds like something that involves blackmail. After fighting for a whole year without having any proof of evidence from them about the rights he suddenly says "I have learned that they picked the CANDY CRUSH name before I released my game and that they were never trying to take my game away." Well if this is true why didn't they pull it out and reveal it before wasting a whole years worth of people's time and money? Just saying.

Well, isn't that nice? Everyone's getting along and are no longer fighting over something which is mind-bogglingly bizarre. To make it even better, this is announced during the Easter holiday, when people are stuffing their faces with candy and most probably crushing said candy.

What the fck is wrong with law makers?


cant they see that this is seriously bullsht, being able to trademark words? Or are these companies paying the lawmakers so much cash to write terrible laws that the lawyers are ruining society because of bribes?


Thus they dont seem to give a sht if they ruin society for the future generation long after we are gone, because theyll all be dead anyway.


I couldnt care less if 10 games had the word blade in them. Everyone should have to right to name anything they want ANYTHING they choose. If 20 games, 14 chocolate bars and 15 movies and 35 cartoons are called blade. Oh well, big deal. May the best Blade win. couldnt care less if its confusing for people.

@nyran125tk Honestly mate you make it seem like trademark law is equivalent to pouring mercury into the oceans.


Primarily a trademark gives a right to a proprietor to forbid others from using a specific name, image etc. in relation to a very specific kind of goods (e.g. clothes, or video games) in the course of trade. This is partly based on the need for consumers or other end users to be able to distinguish different goods from another, so that they are able to freely choose which product whilst being sure that it came from producer X.


So frankly, there is a great consumer/end user perspective in trademark law.


I honestly fail to see how it furthermore ruins society for future generations. Trademark protection comes with a requirement of use, if it is not used within 5 or 10 years, the trademark is either cancelled automatically or can be subject to cancellation actions (depending on jurisdiction). So a trademark that isn't used will sooner or later lose its protection, enabling others to use that mark.


On the topic of King and candy I frankly think they wouldn't be able to get or hold the registered trademark for CANDY for long, given the concurrent use in so many different procuts. The same could likely be argued for BLADE in relation to games or films, if its too commonly used most jurisdictions will recognize that fact and as such it would either not be registered, or deemed to have a very narrow scope of protection.

@Diaketh @nyran125tk if a company could trademark a word they would and yes they very much WOULD own it and make damn sure no one else could use it. words isnt part of nature. Its not like an animal species or maybe it is. If as you say it will be replaced like we are replacable, you are speaking of nature and if we are talking nature. i dont think anything that we all use in nature should be owned by an individual through a law, in any way or form. That goes for words to. Anyone that thinks something in nature that we all use should be owned by an individual or group is either naive or a piece of sht.
