Epic Appeals Ruling In Fortnite iOS Case

Epic lost 9 out of 10 counts in the high-profile judgment, and now it's appealing (as suspected).

As suspected, Fortnite developer Epic Games filed an appeal over the court's recent judgment in the high-profile Epic-Apple lawsuit in which Epic lost on nine out of ten counts.

As part of the case, Epic was ordered to pay millions of dollars due to Epic's violation of store agreements. Over the case of the lengthy legal proceedings, Epic maintained that Apple represented a monopoly because it only allows its own store and payment system for in-game purchases. Judge Yvonne Gonzalez-Rogers concluded in the ruling that Epic could not prove that Apple was engaging in monopolistic behavior under federal or state anti-trust laws, but that "the trial did show that Apple is engaging in anti-competitive conduct under California's competition laws."

The official appeal document (via The Verge) does not include specifics about the appeal, so we'll have to wait to learn more. Attorney Richard Hoeg told GameSpot that appeals from both sides were expected.

Although Epic lost 9 out of 10 counts in the case, the judge did hand down a permanent injunction in Epic's favor in some respects, mandating that Apple must allow app developers to source income from outside of the App Store ecosystem.

Hoeg told GameSpot that the decision "appears to be a near total victory for Apple."

People hoping that Fortnite might return to the App Store in the wake of this decision are out of luck, as Epic's Tim Sweeney has said that's unlikely. Sweeney doubled down on that over the weekend, tweeting that although he feels bad for iOS players who can't play Fortnite, he stands by his commitment to continue the fight against Apple. He said he "wouldn't trade that away to get Fortnite back on iOS."

lol thats some next level of greed on Epic's part - they rather have 100% of nothing than 70% of millions per month.
I wonder why Epic didnt go after MS, Sony and Nintendo for not allowing alternative stores on their consoles? Yea cause that would mean the end of ForKnite on consoles as well.
Epic's publicity stunt failed and now they resort to crying and pointing fingers while all this was their fault to begin with :D

Epic just admit it, you broke apples terms and conditions on which you agreed.

You lost... Just accept the loss and go home.

Not that it wasn't expected, but yes, Apple won and this wasn't just a loss for Epic, it was a loss for all the big and small who use the Apple Store. Apple will continue its monopoly and continue to squeeze everyone who uses its app for every penny they can get out of them. I really can't see what this judge couldn't see because it can't get any more clear how much of a monopoly apple business has been for the last 15 to 20 years.

@doomsdayhell01: You're defending the same company, Epic, who doesn't allow some games to be released on Steam? This is nothing but crocodile tears on the part of Epic.

@ahpuck: just to be clear, you do understand that on a computer, you do NOT need anything to be available on Steam to be able to install it right?

on iPhone, you are forced to publish you app through the App Store, as they aren't any other way to sell it

that is the whole difference people don't see to grasp

@ahpuck:

I am not defending just Epic, I am defending all the companies that use Apple and apple have taken advantage of them for the last 15 to 20 years. So stop your Epic nonsense.

@doomsdayhell01: It's not nonsense. Epic is using money it earns from Fortnite and its unreal engine to literally buy games from devs and make them epic store exclusive. Epic is actually trying to monopolize PC gaming. Steam nor Apple has ever said you can't buy or play a game on a separate service. I get more than 30% taken out of every since one of my paychecks a month in taxes. Should I just stop paying them so I can keep all the money? No. Epic and a lot of these major cry baby companies need to accept someone is always going to take a cut from their profits and move on with life.

So Epic confirmed they're the ones preventing it from being on iOS now purely out of spite. Wonderful company.

@Thanatos2k: what he doesn't get even if there was an altenate way to download the game people wouldn't bother. most people that own iphones are not tech savy to start with and/or would bother. Basically for another store to work it would have to be on apple store first, and you really think apple going to allow that lol.

And i don't think that more then 5% of iphone user would even bother installing an external store, too much trouble for no benefit to them. they don't get the game cheaper or anything more for it. it only benefits the developer.

@cydie: And yet that's not a good enough reason to disallow it. You don't need to skip the freedom to do something (like installing another app store) because you feel like the majority of people won't use that freedom.

Don't excuse the big tech companies for being less competitive...
