Microsoft files to recover Xbox One domain

Microsoft seeks to reclaim XboxOne.com and XboxOne.net domains from a UK resident.

Microsoft has started the process to recover the XboxOne.com and XboxOne.net domains, according to a report by Fusible.

The Redmond, Washington, software giant has filed a claim with the National Arbitration Forum, a body that functions similarly to a court, to settle the domain ownership dispute. The claim is being made against a London resident who has owned both the XboxOne.com and XboxOne.net domains since December 2011. Leases on the domains are not due to expire until late 2016.

Proceedings on the case, number 1501205, were commenced on May 23 this year and are currently listed as pending.

Microsoft may have elected to hold off on the motion for the websites prior to announcing its upcoming console’s final name in order to avoid tipping the public off ahead of the device’s unveiling last week.

They have a right to the domain name. Obviously, anyone typing in xboxone.com into the address bar would expect to go to the website for the new Xbox one system. Currently the owner has the site parked, i.e. not even being used, my guess is he had some inside info or made a very lucky guess. MS should make him a reasonable offer for the domain before pursuing any legal action, as the financials of the legality alone will cost more than what the guy is probably willing to take. If the guy tries to railroad MS as far as payment, MS will win the domain through arbitration, and rightfully so.

If they don't pay (good amount of money) the guy, but just 'force' him to hand over the domain, it's just another stupid thing done in front of their decreasing fanbase.

@erMonezza Its hard to tell what the guy wants. If it was a reasonable amount I would just pay him and forget about having to go through a legal situation over it but he could be asking for something crazy or not even responding to attempts to contact him or something never know.

website will be given to microsoft. Only way the guy would have legal grounds to keep it i believe is if it was being used as a xbox site in a positive way. Since the site is not even being used and the person is basically just squatting on it Im pretty sure it will go to microsoft.

"Recover" means that you had something in the past, it got stolen from you, and you want it back. What you're trying to do from this guy isn't recovery, it's theft. He's had that domain for 2 years already! Just pay him and be done with it!

well, Xbox is a Microsoft Trademark... They can take it whenever they want if the want to. They shouldn't have to pay for their own Trademark, he should have to pay Microsoft to use it.... Its like branding Cows, I brand my cow AW, and any cow that I see with that branding is now entitled to me.. (of course I used a simple argument, but you get the point)

How do you recover something you never had to begin with? If they choose to not create the url themselves, that's their bad. Might be a good thing to look into before you come up with the final name.

Haha. Just kidding. If this guy is a domain squatter then I have no sympathy for him. I have no sympathy for MS anyways and I don't understand with all the billions spent on Xbox One, why can't they just pay him say $5000 and get it from him??? Or maybe even $10,000.

The guy legally owns this domain and that is how this system works. You can own a domain and if someone else comes and makes a product with that name, you shouldn't be able to get it like MS is trying.


If someone makes a product called Windows later on, they cannot sue MS and get that from them. Although a little less similar, the concept here is that the guy owns the domain and MS should just pay him and get it instead of appearing douchey and evil in court.

@fanirama He doesn't own the Xbox trademark that's part of his domain name though, which gives MS the right to the domain in the UK unless of course the guy can demonstrate the reason he chose to buy a domain name with "XBox" in it had absolutely nothing to do with MS's trademarked XBox.

MS isn't being douchey at all. They're using rules for fair use of domain names that the majority have agreed upon to claim a site they are entitled to. They don't owe that fool anything. If he was trying to profit we should be laughing at him for wasting money on the domain before checking whether he even COULD profit from it.

Pay the guy. You had it and lost it. That's how domain names work: somebody on your payroll forgets to renew it, it's not yours anymore. Why should this guy have to be dragged to court because Microsoft was lazy? And he's owned them for years. Pay him or wait until 2016 and hope he forgets to renew them too.

I find this case a lot less interesting than it initially sounded thanks to @allty123 and @fleshpeddler . If the owner at least made an effort to turn those two domains into the #1 Xbox fan site on the web... There are regulations in place now to make "I beat you to it" an increasingly impossible argument. They are public information for all to read. I hope the owner saves everyone time and just let them go.

XboxOne's announcement included several details, albeit indefinite, that got me angry too, mainly because I feared it would set a bad precedence in the industry, but I don't want to criticize MS when they are in the right. It just takes away from other valid criticisms.

If you feel big business should not be able to get everything they want, I partly share your feelings, although I would want regulations that specifically target them instead of applying laws differently to them.

Law makers, at the behest of their constituents, can make biased laws as long as they don't violate laws of a higher order. Existing laws should be applied equitably to all affected parties and issues. Claiming that MS is not entitled to the same legal protection for Internet domains simply because it's a big and powerful company is unjust coming from a layperson and extremely dangerous from someone with legal authority.
