Nintendo Shuts Down "No Mario's Sky," But the Game Still Lives on Kind of

Nintendo has apparently issued a copyright claim that has forced the developer's of "No Mario's Sky" to take the Mario/No Man's Sky game down. Developer ASMB Games wrote on its website that "No Mario's Sky is no more-io!" This was probably always going to happen, considering the game's use of the Nintendo IP.

"Thanks everyone for playing and enjoying our little fan game," the studio said. "We would love to see an official Nintendo game in this style--a Mario Galaxy-style game in 2D within a procedurally-generated universe."

While No Mario's Sky is gone, it's been replaced by what ASMB is calling "DMCA's Sky." It's similar to No Mario's Sky, but uses a character named Spaceman Finn instead of Mario who is searching for Princess Mango, not Princess Peach.

"Featuring crazy Moombas, An Infinite Universe, Muscle, Amazing Physics and a Radical Space Ship; DMCA's Sky is the hackneyed remake-gone-mashup you've been craving," the studio said.

No Mario's Sky removal was basically inevitable. It's also not the first fan-made Mario game that Nintendo has shut down. Two fan-made games, Pokemon Uranium and the Metroid 2 Remake, were recently taken down. Pokemon Uranium's creators say they weren't contacted by Nintendo's lawyers and instead took it down out of respect for the right's holders. The Metroid 2 remake, however, was issued a DMCA takedown notice by the Mario publisher.

Nintendo also had the Super Mario 64 HD fan project shut down. The project was a remake of the N64 game's first level, Bob-omb Battlefield, built in Unity.

Haha this is awesome! Had no idea this had even happened?! Recently traded NMS sky in for Deus ex (no regrets there!), that being said this Mario version looks like more a laugh already, probably less glitches as well.

Not really a surprise, Nintendo doesn't like fan made games. They never have. Really all Japanese studios hate fan made games. And a few western studios too. Even though they fail to realize that those fan made games generate hype for the real thing.

@Red_hot_smasher: Sega shut down Streets of Rage Remake AFTER it was released. So, you can still get it, if you know where to look. What did this accomplish? NOTHING. If Sega were smart, they would've purchased it from the developer, Bomber Games, and released it themselves. I would've bought it, but obviously, Sega don't like money.

@DrunkenPunk800: Yes, Mr. Punk, I agree. That would have been a smart approach. Nintendo should have done the same thing with Doctor M's AM2R. It would have been great to include in a compilation that included Metroid Zero Mission, Super Metroid, and Metroid Fusion.

I do not understand why some people say, "They are just protecting their work."

Surely, there is a way to protect one's work without shutting everything down...?

As far as I know, they just do this kind of thing because they are a stingy company.

That being the same reason for them almost always treating their fans so horribly.

But it turns out to be nothing but spyware, Trojan horses and all other kinds of virus'. The first thing people are going to think. Is that Nintendo is responsible for destroying my computer. @DrunkenPunk800: It does matter what people think about your company. Look at what happens whenever a Gearbox game gets mentioned. People immediately bring up how they feel about Aliens Colonial Marines and Duke Nukem Forever. Saying that after those train wrecks they will never touch another Gearbox game, until Randy Pitchford is gone.

You also have to take into account that they are doing a lot of mobile licensing of their characters. Letting people use their characters for free, could lead to problems with companies who are licensing their characters.

It would cost less than developing a game internally. They could sell these fan games for $10 on their consoles, Steam, and Android, and make a TON of cash.

Problem is, Nintendo are control freaks. God forbid someone make a better game than them. Same goes for Sega, and these other companies.

That said, to avoid all the hassle, smart devs change things up, and make their own unique IP's, while borrowing inspiration from previous games. Freedom Planet started as a Sonic fan game. Retro City Rampage started as an NES port of GTA 3. But, they became their own things, so they can't be shut down.

@DrunkenPunk800: You think how many fan games are developed every year, it would end up amounting to a the budget of one of their games over time. On top of that nobody would pay $10 for what is essentially a flash game. They then would have to share that money with the developers. Why share the money when you can have it all to yourself?

@KotomineKirei: These people are using Nintendo for their own greed. Did you know many developers got their start by taking a game, modding it, and secretly sending it to Nintendo? I know this port company who takes your game, ports some of it, and sends you the port in hope youll hire them.

@iandizion713: Fair enough but i had never heard of it before the media said anything lol. Anyway i got free delivery and installation with my tv plus 250 extra off after negotiation on their already reduced sale price.

TV is 65 inch Sony X93D so can't wait to try out some PS4 games on it :).

Cash still talks compared to credit thank goodness :) . Bought a home cinema electric recliner lounge with fluro blue cupholders at the same time with cash as i thought why the hell not hey :)

@iandizion713: wow! that would be awesome :) . I didn't even think of that to be honest. Any word it may support HDR? . I am holding off on the HDR player for either the Oppo or Sony model. Oppo is out early next year but should be amazing. At the moment there is only panasonic and samsung and i am not too fussed on either of their players. However as the tv upscales everything to 4k and has a pseudo hdr mode for non hdr content that will do me for now.
