Palworld Developer Shares More Details About Nintendo's Lawsuit Against The Game

Pocketpair reveals which patents Nintendo contends that Palworld infringes upon, and how much money it wants.

When Palworld debuted earlier this year, its similarities to Pokemon led observers to expect a legal response from Nintendo. That finally happened in September, when Nintendo filed a lawsuit against Palworld developer Pocketpair in Japanese court alleging infringement on the company's patents. Now, Pocketpair has shared details about which patents Nintendo's claims are based on, and how much money the company wants out of the case.

Pocketpair posted a summery of the information, which reveals that the three Japanese patents in question are No. 7545191, No. 7493117, and No. 7528390. All three patents were registered earlier this year. Instead of going after Palworld for its Pokemon-like creatures, the patents appear to be centered around the mechanics of throwing a ball at characters, riding characters in the game, and shooting at targets.

The lawsuit is asking for an injunction against Palworld, plus 5 million yen (which is roughly just under $33,000 in American dollars) payments--with late fees--to both Nintendo and The Pokemon Company. The details of the lawsuit largely lineup with the predictions made earlier this year by Kantan Games CEO and video game analyst Serkan Toto. At the time, Toto believed that Nintendo's allegedly infringed-upon patents would be "very technical" in nature, and that Pocketpair will ultimately be forced to make a deal with Nintendo.

So far, Poketpair hasn't slowed down its ambitions for Palworld. The game was recently ported to PlayStation 5, and it has even been released in Japan despite the ongoing lawsuit. Poketpair has also struck a deal with Sony to form Palworld Entertainment, which will expand the franchise and create new merchandise and licensing opportunities.

So basically form what's been happening so far, it looks like Nintendo is giving Pocket Pair a speeding ticket instead of actually suing them which tells me Nintendo isn't sure they can win this case at all. It's definitely gonna cost Nintendo more money for suing them than they'll win back whatever amounts their asking back for. To sum it up, Nintendo knew Palworld existed when it was still in Early Access and they could have sued them but nothing was ground breaking Nintendo's law.

Throwing an object to a creature isn't really new nor it belongs to Nintendo exclusively. Nintendo is known to copy stuff from other media such as Luigi's Mansion whenever Luigi is using his vacuum pack to capture ghost and Ghostbusters use their Protonpacks doing the same thing. I'm not an attorney at law, just a guy who sees what's fair is fair and as far as Nintendo's concern, they're more concern protecting their image when it comes to Pokemon.

@davillain: A video I saw the other day from a legal podcast suggested that this might not be anything against PocketPair directly but rather, they’re kind of concerned about the franchise deal with Sony. Would make a lot of sense that they’re afraid of something able to rival Pokémon as a whole, rather than just one indie game that would be barely a blip on the radar.

It is insane to me that companies can patent things like loading screen mini-games or individual game mechanics. I may not care what happens to Palworld in a vacuum, but if Nintendo wins, this sets a really bad precedent for all games going forward. Nintendo would go after any popular game loosely inspired by one of their classics.

Maybe as a gamer, this prospect wouldn't bother me as much if Nintendo was still consistently putting out amazing games that iterate and improve upon previous games, but right now they are not doing that. Going after people who try to do what you Nintendon't is a terrible look.
