Warner Bros. Now Has A Patent For Shadow of Mordor's Nemesis System

This patent could be the nemesis of others wishing to use a similar system.

The Nemesis System used in the games Middle-earth: Shadow of Mordor and Middle-earth: Shadow of War is one of the coolest open-world gameplay hooks we've ever seen, letting you form rivalries against non-player characters based on your previous actions. If you were hoping other games would implement it, however, that will be a lot harder to do now, as Warner Bros. has patented it.

As spotted by IGN, this week the US Patent and Trademark Office announced that a patent for the Nemesis System would be valid as of February 23. However, the page listing the issuing date is not available online at the moment.

Now Playing: Shadow Of War: Definitive Edition - Official Trailer

This followed years of attempting to patent the system that went back to shortly after the release of Shadow of Mordor. A filing from 2016 described a system "for managing non-player characters and power centers in a computer game [that] are based on character hierarchies and individualized correspondences between each character's traits or rank and events that involve other non-player characters or objects."

In other words, it's for the way the world reacts to your own actions. The "hierarchies" mentioned correspond to the pyramid of targets, including captains, you could kill or enslave in Shadow of Mordor and Shadow of War. This created a story that would effectively be different for each player, as the characters you chose to kill or spare could have an impact on your next mission--either helping or hindering you. Should you maim a character during a fight, that would be reflected the next time you see them. The best part came when you fell to them in battle, as they'd get more power and prestige within their own hierarchy and taunt you when they next fought you.

It's unclear if Warner Bros. will use this in a future game. The story of the Shadow of Mordor and Shadow of War wrapped up pretty cleanly in the second game. However, it's always possible it could be used for a completely different project. If a third game took place during a different time period, it could also work while using similar mechanics.

There are a few different Lords of the Rings games in the works at the moment, including a stealth-focused Gollum game that was recently delayed to 2022 and Amazon's MMO. The Shadow games certainly have something special, though, with a brutal take on the Arkham series' melee combat, tremendous powers, and fluid traversal.

The Middle-Earth: Shadow of _ games are awesome, and a good aspect of the games is the nemesis system.

My only concern is that I'd like to see similar systems implemented into other games, but I'm afraid they won't b/c of lawsuit risk.

@rufus_:

Didn't they publish the Batman: Arkham, F.E.A.R., and Mortal Kombat games too?

Those were all pretty good games IMO.

@rufus_: I see where you're coming from. I just wanted to mention some games that they published that I really enjoyed, (which doesn't make them subpar in my opinion).

Thanks for sharing your thoughts! 😺

@rufus_: I thought WB Montreal developed one of the Batman games. I could be wrong.

But I hear what you're saying.

How is this even patentable? It is neither novel nor nonobvious to someone with ordinary knowledge in the field of video game programming.

@stiefjac: Ever wonder why every game company except Namco made you sit through a loading screen staring at a picture or an animation instead of giving you something to do in an era where loading screens in games took 30 seconds or more? It's because they patented the idea of playing a minigame during a loading screen. And for 17 years, we were stuck staring at a fucking screen doing nothing because of a patent. Patents are not good for consumers, they're good for businesses.

This is an umbrella that could get on the way of the design of completely unrelated games.

I have no idea how that could possibly be patented. They basically described every game since double dragon.

Also, and just to throw it out there, Shadow of Mordor is a sh*t game. Mechanics are horrible, striking is cumbersome and the whole game just generally sucks.

This is absurd.
Noone is allowed to design a game with an ally/rival mechanic in future unless WB approves it?
Absolute nonsense.
All the games nowadays used designs and mechanics from previous titles, altered or improved them so we have a better experience...
The Nemesis system was a great idea and its a shame that the "evolution" of that system is greatly slowed down coz of no competition

@sladakrobot: Yes, it is sad but remember this is America where one can patent anything even words that everybody uses. Now just because The developer uses an system that is patented does not mean they will not necessarily allow another dev to use as it will not be free and in some sense it may bring in extra revenue for them. But again this is Capitalism at work as the US is an capitalist country even though some of the actions makes one scratch their head.

It's very difficult to patent a term, a mechanical process that does a > b sure, but simply labeling it nemesis system will only draw attention, however I doubt it can be sued towards, plus o suspect it only applies in America .

It's so they can sue the shit out of anybody who puts a feature in their game that is vaguely similar

@parabol69: Because having a patent means you can monetize the mechanics.

@zmanbarzel: That's it in an nutshell but if another provide some sort of monetary compensation the company may allow them to use it through licensing.

booo. wb has done nothing but shit for videogames.

netherrealms mk were always good but peaked at mk9 which was basically still midway before wb managed to cling their tentacles all around it

arkham asylum was mainly done under eidos and they turned probable shitty the dark knight movie game into creatively and technically remarkable game that was a full experience.

around those moments wb had taken full control and as good as arkham city was as a game, it was full of shitty practices.

now all they have is shitty practices and shitty games. netherrealms can still do ok fighting core and thats the only grace the entire wb gaming division has.

@PrpleTrtleBuBum: i can almost imagine the internal discussion around arkham city

wb rep: we believe your game is too good but since its almost done just release it, but fill it with atleast 50 packs of dlc that we will sell to highest bidding retailers. just remember that your next game needs to be shitty.

5 years later in wb hq:

wb rep: hey has anyone noticed that rocksteady hasnt released anything in years! lets go check it

they rush at the studio:

what the hell are you doing here!? making another batman game and its been years already?! release the fucking game now! whaat its not ready? doesnt matter just do it!

It's ironic how they do this after they just shut down the server that runs this feature in the first game they ever put it in.

Always disappointing to see companies laying claim to software (i get it its business needs to make money etc) but the nemesis system is good but no where near perfect and has so much potential to grow and expand if it we're shared between devs easily. Almost any open world game could implement its own version of the nemesis system and be greatly improved by how dynamic and replayable it makes the game.
