Gamasutra uploaded a newspiece today about Epic filing a motion to dismiss in their legal struggle with Silicon Knights. For all those returning from Mars, SK filed a lawsuit against Epic last month that stirred quite the controversy.

Now Epic retaliates with this motion which partly says that SK's suit is "a cynical effort... to unlawfully enrich itself at the expense of Epic Games".

well, epic has a point! after hearing about this trial i looked into SK's game (cant remember what its called :S) but anyway, it looks like something i'm gonna pick up now :P

Did anyone play Fatal Inertia? Koei might want to think about joining the lawsuit. Of course, its possible that the problem was Koei has/had little idea of how to build a quality racer.

That's a valid point, I didn't expect much from the game but the graphics were atrocious. I think Epic is going to wind up being the loser in this no matter what. Outside of Gears of War and Unreal Tournament 3 the engine looks like a farce.

Epic's argument seems to be purely speculation, and I don't think it will be enough to withstand everything that SK is gonna bring to the table.

my 2 cents on the whole U3 schbang is basically its a case of GIGO.

(garbage in, garbage out....basically its what you do with it, not the damn engine)

Absolutely, I'm just pointing out that theres other UE3 games that are shaping up nicely.

Edit: I found this reponse from Bioware about Mass Effect possibly being delayed because of UE3.

I didn't see it in the GS article, but the Kotaku summary mentions an injunction. I really hope Epic was smart enough to file for an injunction against selling/distributing Too Human until the copyright violation claim is settled. That, in essence, would put this whole thing to bed. If SK can't ship Too Human, they have no money to litigate the suit. The best outcome they can hope for in that situation is that both parties agree to drop all claims...no harm, no foul.

Predictable countersuit aside, Epic doesn't have to prove anything. Dennis Dyack has the burden of proof. Some of you think Epic has to prove something just because Silicon Knights sued them. Au contraire. Very few people really understand that. Dyack probably doesn't. I think he thinks he's going to get justice as he sees it.

That's not what a trial like this is about.

This is not good for gaming.

Bioshock started off as UE2, but switched over to UE3. Mass Effect has always been UE3.

The interesting thing about this mess, is that Microsoft is caught right in the middle. What if MS are really counting on Too Human for next year? True, but Too Human is a wildcard. Gears 2 is a guaranteed megahit. Everything Epic develops is pure gold (the bad Unreal games were not developed by Epic). I know which side I'd be on if I were MS. If I were them, I might even pay SK to shut up. Besides, MS has GTA4 to carry them next year. Plus, copies of Halo3 will still be flying off of shelves well into next summer.

One isn't UE3, the other two were delayed multiple times, Stranglehold is delayed indefenitely on PS3, Mass Effect hasn't showed any true gameplay screens. KOTOR ended up looking nothing like it's screens.

Both the Mass Effect (Bioware) and Bioshock (Irrational) have gone on record of saying they are using heavily modified versions of the UE3, where they basically used the engine as a template and changed it upside down and inside out to suit their franchises. The only reason im bringing this up is because someone said that outside Unreal Tournament 3 and Gears that the UE3 was a farce. They are right. Epic is gonna get bagtagged hard here for there shenanigans.

As far as I'm aware, all 3 use UE3. Stranglehold was not delayed for the PS3, that was some type of misunderstanding. There are plenty gameplay videos of Mass Effect, i cant remember where i saw it but someone has like a 20min walkthrough of combat and other stuff.

Ah, that makes perfect sense then. I suppose Bioware and Irrational didn't have any issues with the engine since they barely used any of it.

Bioshock uses a modifed version of UE2.5. However they do use some of the newer tools from UE3.

While both developers did indeed modify the UE3 engine I would imagine that the engine served more than just a template. I don't see why they would gut the engine and rewritelarge portionswhy paying a large amount to Epic for a license when they could have made their own.
