So i went to Gamestop today to trade in some games and get Resistance 2 and Valkyria Chronicles. I would of sold sold em' on ebay but i didn't want to go though the process... So I got the new games but their boxes were already open. This is standard procedure according to the manager in a phone call afterwards, but my main question is, how do I know the game they put in the case is new? The case definitly isn't new (based on all the smuge marks and dryed crap on it). Anyways, the reason I'm confused is becuase I paid for a new game, that includes the case and manuals sealed, and didn't get that. I don't know why I didn't question it but, but at least the game works... :?

They claim their open games are new. Just tell them you won't accept them as new unless they're still sealed.

But then be prepared to not buy the game from them. They try to pull that all the time.

when you say "that" do you mean selling new games in open boxes or just flat out lying and selling the used version as new?

The disc itself is for sure new.

It would be illegal to claim it "new" and sell it used. False advertising and breech of contract.

Yes, they do gut new game copies and file the actual game in storage, while still selling the product as new. I'm told that employees can even rent these products from the store and bring them back, but they'll still be considered a "New" product.

I never did understand this policy. And if you say it's to stop theft, why can't they have a display case and keep sealed games in the back room or something? I'd never buy a new game from GS, to be honest.

To me, I actually don't mind it that much, unless the disc is pretty scratched. That's why their PC games are ****.

They claim it's new, but really, we don't know for sure. I'm hearing bad rumors from Gamestop employees that they take home gutted new games and play them. That's not new is it? But they still sell it as new. I saw some new gutted games that looked worse than used games. The games work fine but still, it's bothersome.

I think they are ways to tell. I'm pretty sure I once bought a "New" GBA game that already had a save file in it.

The issue really hasn't come up that much but when I do find myself in a position to purchase a gutted copy, I check the Disc to make sure it's flawless. If it isn't, no sale.

I'd take your copy back considering the condition of the case.

I worked at gamestop for almost 2 years. You know all those display boxes out on the floor? They arn't just decorations, theyre the real boxes. We have to take the games out to put them on the floor to protect them from being stolen. Gamestop will always try to get you a sealed copy if they have one, but if they're down to the last copy chances are the plastic has been unwrapped and the game has been removed and locked up so we can display the box. I never once saw anyone in any gamestop (and I had a management position) try to pass off a used game as a new game. What's more likely is that the employees that we're removing the disks were less than careful about it and got the disk dirty. If that's the case, you have every right to go to another store and buy the game there!

It's not a perfect system, but right now gaming companies are unwilling to send gamestop empty cases to use as a display, and the company likes to have a box that isn't sealed in a plastic case *coughbestbuycough* so you can flip through the manual inside.

We know that. The point is if they're unplayed or not. Also, what really gets under my skin is how they sell new games for full price even without the actual box or manual. That's ridiculous.

NEVER BUY NEW games at GameStop. BUY ONLY USED. Ever since GameStop acquired Babbages, Software etc andEBGames, it has been a collector's nightmare to buy anything NEW. GS considers it "NEW" as long as it's labeled "NEW"irregardlessif someone stepped on it or ran over it witha truck. If you must buy new, go to Target, WalMart, or BestBuy, or a privately owned gamestorewhere you will be given a sealed copy every time.

You are correct sir, employees are able to borrow the game for the night or a few days if they have multiple open "new" copies. I was a manager at a Gamestop and hell i borrowed some games myself.

That's my stance on it too. Once they open it and put their hands on it and stickers on it, it's not new. Doesn't matter if they play it or not.

So that idiots can look at the cases and read manuals and stuff, all games on the wall are "gutted"(their disc taken out and stored) so that the games on the wall cant be stolen. These games are new and have not been used. If you ask for a game and we have only one copy left, that 1 copy is the one we gutted and put on the wall for people to look at, so we take it and put the disc back in and sell it. Nothing else we can do about it

Another way of looking at it is this -- would you be able to buy a sealed game from any store, unwrap it, and then return it as new for your money back even if you hadn't played the game? No. If you tried to sell it back to GameStop, would they give you full price for it? No -- they'd only give you whatever they are paying for that game used. GameStop has their own definition of "new" that isn't the same as any other store. Think there'd be a bit of an uproar if Best Buy, Wal-Mart, Target, Toys 'R Us, or whoever decided that they were going to unwrap every single game, CD, DVD, etc in their store and sell them the way GameStop does? I don't buy the "they do it for security" explanation either. Keeping all the games behind the counter and making people ask for them when purchasing them is sufficient to prevent theft, and you shouldn't need to unwrap any games to do that. Yet they do. I don't know the exact reason why, but I'm guessing that saying it's for security isn't the full story.

Most new games I've gotten at Gamestop have been sealed. But I know that it can often be a gutted new game - and if so, you see all this before you pay for it. I usually only get used games at Gamestop for their deals and 10% off with Edge Card. Than get new games at Toys R Us for their deals or at Best Buy with Reward Zone Certificates.

Anyways, unless there is something majorly wrong with the 'new' game you just bought, then what does it really matter anyways. And if your that bothered by the principal of it, you can still return it. Its up to you now, and always was.

i know the manager at my Gamestop.

But besides trust I observe and after selecting the case of the game I want I watch her or another employee find the game disc and remove it from a sealed wrapper and put it in my case.

I have never had a problem, in fact I one time had to return a used game within the 7 day period and when they did not have a used one for replacement I got a new one instead and that was GTA: San Andreas.

Really? Huh, because this has NEVER happened either to me, or any of my friends, both those as consumers, or those who work at Gamestops, which leads me to believe this to be, at worst, the employee behavior a particular store, and not a policy matter.

I swear, people like to smear Gamestop almost as much as they liked to smear EA sometimes. I'm not saying you are saying this merely to do that, ASK, but a lot of people seem to pass Gamestop off as some ultimate evil like

GS considers it "NEW" as long as it's labeled "NEW"irregardlessif someone stepped on it or ran over it witha truck.

TC, I'm not sure you were ever taught this, but if you say the word "no" to an employee while you're purchasing the game, they will stop! :o Also, if you say "I want a sealed copy," we're required, by law, to try and give you a sealed copy. If it really bothers you that much, then just speak up and get a sealed copy. I don't understand why you guys say you hate GameStop. A little sleeve of plastic, that you're going to take off anyways, is really that important to you? We have to gut copies; publishers simply won't send us a box art, and how else are we supposed to display the game? I refuse to buy an unsealed copy of a game, and I freaking work there!!! In my eyes, if the disc is opened, ask if they can take $2 or $3 off the purchase price; while it's not required, many employee's in my area (including myself) will be more than happy to deduct a bit off the price if it's unsealed. GameStop is a business and as a business, we are required to advertise our product. While the Kotaku article is right, and we are allowed to "rent" games for 4 days, GameStop looses money because they don't sell it new. Used game bring 100% profit back to the company, while new game profits bring ~13% profit back to the store (from what I've heard). Be nice, understand where we're coming from, and if it really bugs you, speak the **** up.

Funny thing I bought Dead Space just the other day "brand new" but they only had one left so they gave me one that goes with the display box which was in terrible shape but when I got home to inspect the game itself, it had several small scratches and fingerprints on it. Suffice to say I returned it the next day (to a differnt Gamestop) and exchanged it for a real new, sealed and un-gutted copy without any hassle. It still however pisses me off that it happend in the first place so I doubt I'm gonna do buisness wit GS for a while.

Thing is I've bought several "new" games from Gamestop that they had multiple copies of yet the game I got was still gutted. I myself prefer an un-gutted and sealed game but if the cover and more importantly the disc is in new condition I'l let it slide normally but this last time is unexcpetable and even though I did get a new sealed replacement I still feel kinda ripped off.

Don't buy from gamestop, you can get better deals on ebay or craigslist for used games. For new games just go to target, best buy, and amazon.

When they tell me it's new, I tell them to put themselves in my shoes. If they bought a new game from Amazon and it arrived unsealed, would you accept it as new? They usually don't know how to respond to that.

Amazon doesn't have to worry about storage issues, not having box art to use as display units, security, and other matters which are several reasons behind having to gut games.

Do I like buying games that are unsealed? Not really, but if I WANT that assurance of having an unsealed game, there's an easy solution - preorder the game, which means they'll set aside a sealed copy for you, since you already paid for it. Also, while so many people here champion the likes of Target/Best Buy...those stores, at least near me, don't carry the more obscure games that I tend to frequent getting, in which case I have much better luck getting such a title from the Gamestop, and in some cases, I can preorder a game that's going to be published in low numbers, and guarantee myself that I'll at least get a copy, which is a service that the larger retailers typically won't have (and I try to avoid buying through online retailers as much as I can).

If you don't want a gutted copy, then just ask for a sealed copy of the game at the counter, if they don't provide one, find a used copy of the game, or just walk out and go to Best Buy or Wal-mart. Simple as that.

Always buy used, its well worth saving alot of money in the long run. If it doesnt work , just take it back later that day or the next day for another copy. its no big deal. I never bought a new game that was'nt sealed though either.

This may be me just being overly picky but I stopped buying used games at Gamestop when they started putting the price tags on the cover art. I don't see what the point of doing that is and if I'm buying a used game as a present, I don't want to have the price tag showing. Sure I could tear it off but I also risk tearing the cover art too and I'm really picky about that.

They stopped putting it on the actual cover art at all the gamestop's I shop at. Just on the plastic case and they seem easier to take off now. They tuck a sticker with the back still on it into the spine of the case, but not actually sticking to the paper cover.
