A legacy device is one that is no longer supported by the manufacturer. That said, the DS is actually not a legacy device, whereas the PSP is, I believe. Unless you can still buy them new. However, the PSP also has a dedicated forum, iirc. So, yeah.
I think they should be discussed here as well, since they've been replaced by newer handhelds (3DS & PS Vita). But Nintendo DS, as little as it is, is still seeing games released for it.
For the purposes of this forum, it is anything not covered by its own forum, which excludes PSP and DS right now. There are still major releases for the DS (as in Pokemon big) so that makes sense at least. Dunno about PSP.
Personally, I'd welcome discussion of these systems since discussion of them is dying on their own forums.

The DS and PSP are still active systems, Not many games coming in 2012 but there are a few. These systems are in that awkward in between period of having their successors out in the retail enviroment and when the system is declared dead. Which is either the last offical game is released and the system is no longer being made.
The DS series and the PSP techically are legacy systems and techically still active. In the PSP case with 71.5 million sold since December 2004. Sony might let it last the full ten years as PS1,PS2 and PS3. If only because it sells well in Japan and Asia. While the PSvita has been slow to catch on in a poor worldwide economy. So looks like PSP will make it to 10 years by default.
Active systems never meant "Legacy" otherwise the the PS1 would not have been legacy until 2006, the PS2 discussions and Gamecube discussion before around 2008 should be erased, and the GBA discussions before 2007 or so would have to be erased to.
