Rare developed the game. If it was released/ported to the DS, it would be a collaboration between Nintendo and Rare, like Diddy Kong Racing was.JDUB_xActually, since Nintendo has the full rights to the Donkey Kong series, they could make the game alone. After all DK64 is coming to the Wii's VC with no involvement from Rare. I think they just chose to involve Rare in DKR for the DS, or, more likely, the game was actually Rare's idea.
DK is owned my Nintendo. Banjo is owned by Rare which means BK is on the 360. Nintendo can publish Rare games on other consoles without Rares permission as they own the characters thus DKC on the Wii.Technically donkey Kong is a Nintendo character so whatever Nintendo wanted to do with him is up to them, but because Rare didi develop DK64 they'd need rights. Hence the same reason Banjo Kazooie's coming out on the 360.

That would be true if the original development team still worked at Rare. Most of the talent at Rare left around that time, so it's doubtful that the original team still works there. Yes, I'd buy a Donkey Kong DS game... whether it's a port of 64 or a -- GASP! -- new game. They keep peddling stupid spin-off garbage and forget that the reason anyone even looks at them is because they liked the original series that featured these characters.
Why won't they make this game? Who wouldn't buy it? You guys are probably going to say I wouldn't buy it because I suggested people would buy it, but seriously Super Mario 64 DS sold good, why not Donkey Kong 64? And I'm sure they have rights from Microsoft to make it.DMRaMeX
Could the DS handle a game as massive as DK64, though...? They had to tone down parts of Mario 64, afterall, and DK64 is gigantic compared to Mario - the N64 required the expansion pack to play and everything..
Just a thought. I'd buy it in a heartbeat if this happened simply because of how deep DK64 was and the number of things to do and collect in it.

Mario 64 worked great. DK64 would too. Um_Wut
It worked well to a degree,but the game didn't feel as smooth or as entertaining without an analgoue stick.
