  1. Does the 3D take time to get used to? Is it supposed to pop out or just be a window effect? Because I'm getting window effect, like depth with a few things in Ocarina of Time catch my eye as if they were right in front of me. And yes I have the slider alway up and I can see 3D perfectly, this has been confirmed before i got the 3DS. As the days have passed it's gotten better, first day me head hurt slightly when playing, 2nd day all I was getting is a burning sensation in my eyes, but now it seems to kick in instantly.
  2. Is the top supposed to be flimsy? I mean It's a little annoying, not to the point where I think I should take it back or that it's shutting close with the slightest move. It's just that it's annoying, I have big fingers/hands and when I tap the shoulder buttons, it feels a little shifty.

I'll wait for others who are more qualified to answer your questions, but I'll give my thoughts:

I could never get used to the 3D and I always have it turned off. That being said, noone can get used to 3D in one day, it takes time. So if you're already used to it, that is a good sign.

The trigger buttons are flimsy? I don't think its supposed to be that way. Mine are very much in place and feal comfortable. I'll wait to see what others say though.

I got used to the 3D in one day. My trigger buttons (the L and R buttons) are firm for the most part and are real responsive.

EDIT: after reading your post more therally, are you talking about the trigger buttons or the top half of the 3DS? If it's the top half then I have to say that, again, for the most part my upper screen is firmly in place with very slight movement if I were to shake my 3DS gently. I belive they leave that slight movement in so that that it doesn't get jammed.

1. The 3D took me about a week to get used to. It was my first time experiencing 3D so my eyes were irritated at first. A few days after I bought a 3DS, the text on these forums started to look 3D. It's a common side effect and it would clear up in a day or two. 3D that pops out or 3D as in depth only depends on the game/video.

2. The top screen of my 3DS is a lil bit flimsy. Doesn't bother me as much since I've been using a DSlite with a broken hinge months before getting a 3DS.

Never had a problem with the 3D effect. Maybe I am an oddball though because it seems like everyone else here does o.O

Top screen is definitely flimsy compared to the DSi which snapped into place and would not budge.

My eyes felt tired after the first DOA sessions (!?) but that went away quickly. At first I couldn't use full 3D either but now that's no problem. The top is supposed to be a little loose.

The 3D was great for me the second i first turned on the 3DS. Im not exactly sure how everyone thinks they have to adjust to it, lol. It is mostly a windowed effect, but some things pop out once in a while, especially things like sparks or floating dust particles. The only problem i have with the 3D is the fact you have to hold the screen so perfectly to see it.

The floppy top screen is normal. I dont like it, but it is how Nintendo designed the 3DS. Some people seem to get lucky and get a more tighter unit.

I don't play it long enough to get headaches. About on average 40 minutes a gaming session, at the moment, it's one dungeon at a time on Zelda, then I switch if off for the day or so.

Yes. Your eyes will adapt to the effect overtime. I timed myself the very first time I used it and got over 30 min before I felt a slight head ache but now I only feel head aches when I'm tired or not at all.

Yes, the hinge is suposed to be that way.
