I'm not getting Goldeneye if it's on XBLA... It shouldn't be on XBOX... It should be on Nintendo, the console it was originally released for... I really want to play that game, but it's not worth it if it's on XBOX... I hate you Microsoft...Niff_T

Nintendo sold RARE to Microsoft. Also, the new Rare is not the same Rare that Nintendo worked with. Most of talent are now with Free Radical. Microsoft now has a Rare that is bad. Nintendo sold them because they were in downhill. If Microsoft was not there, Nintendo would sell it at Sony.
As for the topic, I don't really care. The only game that I would be interested was Banjo-Kazooie in the VC. In the article, the original Banjo-Kazooie would be on XBLA. This game would have been remade. There were too much Donkey Kong mentions or ennemies on that game. It would not be the original game. If Rare put the real original game, Nintendo could sue Microsoft because of some licensing characters. The huge brown beaver on BK is one of them. The beavers were at DKC. We all know that Donkey Kong Country is in the VC. So, the beavers are now part of the NIntendo family.
I think a non-exclusivity contract would work to put both games on the VC and XBLA. Nintendo could release the real original games and Microsoft could release remakes of them.
Tbh, I would rather prefer it gets released on XBLA, since that'd mean the developers would have to actually open the game up and rewrite the code to make it run on the 360, which gives them the excuse to include new features (online multiplayer is a given), achievements, enhanced visuals (1080p it up with 8x AA & 16x AF, sure it's a low-poly game, but it'll look super sharp while it's at it), and etc.
Where-as Nintendo on the other hand would have just plugged it into their emulator, maybe add a useless photo-feature, then call it a day.

Don't blame Microsoft; blame Nintendo for letting them go. Can you really blame them though? How many good games has Rare made in the last 5 or 6 years they've been with Microsoft. I can count them on one hand.

Yeah, i suppose its unfair since it was released on the n64 Nintendo should have rights to these games, but rare is the maker and has the power......but im guessing Microsoft bribed Rare for it
It dont say in there that those games wont come to VC, It just says they may go to XBLA. No way nintendo will let those games go to xbla and not VC also, nintendo owns half the source codes to those rare games. Rare still puts games on the DS so they still have a good relationship. Best case they come to both.jmizzal
Nintendo doesn't have the any choice as to what Rare does with the games. The only games they have choice about are Donkey Kong and Star Fox because they created those characters. Banjo-Kazooie, Goldeneye and Perfect Dark are all owned by Rare and they can do what they please. While it would be nice for Banjo to come on the VC, what ever happens happens.

well if you have ever played any of the N64 games most of Rare's were some of the best at the time, but to point out Rare never made the first Star Fox the only one they made was Star Fox Adventures which has to be their weakest game as far as what was promised to what they delivered but they were lazy at that point and seemed to just want out, I'm not greatly fussed anyway as I have most of Rare's games from the N64, if it turn out true or not, but to be honest if the did turn up on XBLA it would ruin the originals if they tried to change them, to be fair putting them on the Wii would keep them in tact and just clear up the terrible blur that all N64 games suffered and smooth it all out nicely, as it has done with all other N64 ganes ported to it, fixing what was the main problem at times because of the compresion used to store them.
Nintendo can still put Rare games on the Virtual Console because they were Publisher on those games if they don't change anything in the game it can still go to the Virtual Console Nintendo just couldn't update the Graphics or add online to the Game.Nintendo_Ownes7
They were the publisher *then*. They would have to renogiate with Rare to get the rights to re-publish them on the VC, modified or no, and that isn't going to happen when Microsoft can capitalize on their past projects easily.
Update: Aparently Nintendo doesn't want Goldeneye to arive on XBLA. All the below information was obtained from the site that the TC used in his original post.
"Technically speaking, Activision doesn't need Nintendo's permission to do anything with Bond, but given the original release of the game and their good relationship with the Nintendo, they decided to play fair and ask first. Apparently, Nintendo's CEO Satoru Iwata simply said "no" to any form of GoldenEye in any console but their own.
Activision then denied the use of the licence to keep their good terms with Nintendo.
The funny thing about it is that during the bilateral negotiations between Microsoft and Nintendo, the Japanese were offered the possibility of getting the rights to release the original GoldenEye 007 for their Virtual Console in exchange of their blessing for a special edition on Microsoft's Xbox Live Arcade. Rumour has it they didn't like the deal, which was, in any case, beneficial for everybody. Including their users.
So basically Nintendo wants GoldenEye. Microsoft wants GoldenEye. Rare wants GoldenEye. Activision wants GoldenEye. And players yearn for GoldenEye. But thanks to the first ones, nobody gets GoldenEye, unless Microsoft or any company without strong commercial ties with Nintendo obtains the Bond licence someday"
