What does it take to get a character in SSB?

I ask this because I've always wanted to see a character like Goku or someone in a SSB game(powered down obviously).

But Sonic and Solid Snake are in Brawl. So I'm wondering, what does a character need to do to get in?

Anyway, besides being on a Nintendo console, just the IP owner's approval. And paying royalties, of course.
