No I'm not trying to make fun of you but I am trying to point out how odd your theory of people confusing the two is.
I see. I don't think you're quite following what I'm saying. You mentioned that the point of an ad is to attract attention, I don't think the way to do that is by copying one of the most common commercial themes. I'm not saying that people confuse them, only that you don't attract attention by being the same as everything else. This is just another commercial with a guy yelling at me to buy a product...in fact, I won't even have a chance to confuse them, because I'm not going to pay attention to a commercial that's just like all the others. I won't give it the time of day, and I don't think most other people would either.
Not that it really matters, it's mario kart and it's going to sell like crazy no matter what.
