71-year-old black man found guilty of manslaughter, jury rejects Stand Your Ground claim

A Tampa jury has found Trevor Dooley, a 71-year-old black man,  guilty of manslaughter in the shooting death of his white neighbor, 41-year-old David James, in front of James then-8-year-old daughter Danielle.

According to the Tampa Bay Times, the jury rejected Dooleys claim of self-defense under the state of Floridas Stand Your Ground law.

One of the jury members said the law did not apply to this case, while jury foreman Walter Joss said, The whole silly thing was over a skateboard and it just escalated.

However, the Jamaican-born Dooley believes that racism played a big part in his conviction.

He told reporters, Do you really think that if it was the other way around and the skin color would be different we would be here today? We wouldnt.

James daughter, who has been in counseling since the tragedy, did not remember much of the incident. She testified that she only remembered Dooley trying to go home.

The incident occurred in September 2010, when James and Dooley got into an argument over a skateboarder who had been given permission by James to skateboard on the other side of the basketball court where James and his daughter had been playing.

Neighbors who witnessed the altercation and later testified said they saw Dooley flip up his T-shirt, revealing a gun in his waistband, while cursing at James.

Dooley, who is 5-feet-7 and weighs 160 pounds, said in his testimony that he shot the 6-foot-1, 240 pound James when he felt his life was in danger because James had his hands around Dooleys neck and was trying to reach for his gun.

The Times also reported that along with manslaughter, Dooley was also convicted of improper exhibition of a weapon and open carrying of a firearm, both misdemeanors.

Dooley will remain free on bail until his sentencing by Hillsborough Circuit Judge Ashley Moody on Jan. 10.

yes i do realize it's pretty old but i think it's still pretty relevant given that one recent case everyone's been talking about and the fact that a lot of racebaiters have been curious as to what would be the case if the "roles were reversed"

I never trust a newspaper article reporting on a trial. I'd have to watch the trial in full to make a decision.

He is a older man he should know better than flashing his gun. Even so why shoot the kid??

Even a old man can grab or kick balls then use small joint manipulation for a set up and then finish the young idiot trying a old man. Now if the kid had a weapon by all means two to the chest and one to the head. Still a black man most likely won't get a fair one in the JUST-US system. Yet another black man will be locked in a cage and at that age most likely die in a cage for defending himself.

You dont yell at someone, flash your gun, and shoot someone after they try to wrestle you because you just endangered a child infront of another man. There were witnesses that testified exactly that. He should go to jail.

Flashing his gun beforehand was not a smart thing. If he had pulled it after the dead man's hands were around his neck, then yeah, then he could maybe have won stand your ground immunity, but he made the threat of at least grevious bodily harm or death when he flashed his gun.

If my reading of TC's excerpt from "The Grio" is correct, it seems that Dooley flashed his gun first, and then James choked Dooley. Dooley then shot James claiming it was self-defense, but quite frankly if Dooley drew the weapon first, it seems to me that James was the one acting in self-defense.

I must retract my earlier statement after reading the story. That old fool should be locked under the jail. Why?? He made a clear threat to that kid when he flashed his gun. The kid was trying to defend himself from a deadly weapon and acted as such. The race card is just a smoke screen and so is the self defense claim in this instance.

Why single out Florida? Concealed carry is legal with a permit. Open carry....no.  No state I can think of let's you threaten someone with a gun.

Now, different states have different rules, and if my memory serves me correctly, Florida does not allow your weapon (handgun) to be visible even with a carry permit, unless you are inside the home. If you don't have a permit, you can't carry it period, open carry, or concealed. I for, example carry mine open sometimes, and concealed most of the time as it is allowed in Georgia either way with a carry permit. Heck, I can carry my AR15, openly, but that's a long gun.

The law needs to be changed.. there is no such thing as self defense. IF you so much as say anything, let alone do anything to someone.. in self defense or not, you will be arrested and charged. You cannot threaten anyone. Why do you think people are getting arrested for it. People are making a big stink about that teen in Texas who is facing 8 years for doing so, even with the claims that he was joking. Brandishing a weapon (meaning showing, waving it around, etc) is a threat which allows someone to defend themselves.

In this case, the old man threatened the younger man and when he tried to defend himself by choking the man, he was defending himself from a threat of greivos bodily harm/death. That the man shot the younger man after brandishing said weapon is murder and not self defense. Eyewitnesses backed that up.

Because Florida has some really bizarre laws and news stories that come out of it. It strikes me as so odd that open carry is illegal. I'd way rather know if someone is carrying a gun. I had no idea lifting up a shirt to reveal a gun is suddenly a threat, I certainly wouldn't try to strangle a guy after he showed me his gun but hey that's just me. Anyone have any links saying the shooter openly threatened?

If you're on the ground being choked and the other guy is reaching for your gun isn't that self-defense? Last I checked having a gun shown to you isn't going to make you dead.

If you're on the ground being choked and the other guy is reaching for your gun isn't that self-defense? Last I checked having a gun shown to you isn't going to make you dead.

You don't pull your gun on anybody or even show that you have a weapon on you. If you pull a weapon in an argument, you're the one who is responsible even if it's just a quick flash.

C&C weapons are for self defense only. Sounds like he was clearly using it as something to intimidate with.

Um, this sounds like the James guy jumped him as he was walking away. How is that not defending himself?

If you're on the ground being choked and the other guy is reaching for your gun isn't that self-defense? Last I checked having a gun shown to you isn't going to make you dead.

Well if he threatened the other man it's not self defense if he then gets his ass beat

I did. So the skateboarder didn't see him flash a gun but saw him pull the gun when turning around. Spun around when? When James spun him around? The article isn't clear on that. Did he go to walk away and them pull a gun on James or did James go after him and then have a gun pulled on him?

I'm just going off what I was told about stand your ground in the Zimmerman trial topic. Obviously that other person was wrong then.

Skateboarder wasn't the only witness.......

Um, yeah I know. The other witness said that Dooley was walking away when James jumped him. So...what is it? Did he get jumped when walking away or did he pull a gun on James causing him to react?
