Apple sues Samsung for 'copying' the iPhone and iPad

Whoa! In the world of big-time lawsuits, this must be just about the biggest. TheWall Street Journalis reporting that Apple has sued Samsung Electronics for copying "the look and feel" of its iPad tablet and iPhone smartphone. This relates to the SamsungGalaxy S 4G, which bears more than a passing resemblance to the iPhone 3G / 3GS models, and the slightly less obvious Epic 4G, Nexus S, and Galaxy Tab (presumably the older 7-inch model, since the newer ones aren't out yet) devices. The claim for intellectual property infringement is phrased as follows:

"Rather than innovate and develop its own technology and a unique Samsung styl.e for its smart phone products and computer tablets, Samsung chose to copy Apple's technology, user interface and innovative s.tyle in these infringing products."

The lawsuit was filed in the Northern District of California on Friday and seeks injunctions against Samsung, damages (both actual and punitive), and a finding that the infringement was willful. Lest we forget, the rarest outcome in such legal tussles is for anactualjudgment toactuallybe handed down, so the greatest likelihood is that this will just lead to another round of grudging handshakes and licensing going one way with money going the other way, but still, it's fun to see the big dogs barking at each other.

Another aspect to these proceedings that shouldn't be overlooked is that, on the software front, they boil down to iOS versus Android (again). When Apple calls Samsung uninventive in its user interface, it's talking more about Android's perceived imitation of the iPhone's interface than whatever TouchWiz tweaks Samsung has slapped on top. And hey, if you're going tosue Google indirectly, you can't leave a major player like Samsung outside the courtroom, it just wouldn't be fair.

pretty stupid of Samsung to do that, their Nexus S already looks and feels better than iphone...

man, imagine how technologically backward we'd be today if this patent and suing business was as strong in the past 2000 years as it is now.

overpriced phones? last time i checked the iPhone starts at 200, most of the android smartphones are the exact same price, or more in the case of the thunderbolt

also look at the second comparison. in terms of size and shape they are almost identical, and the samsung only has one physical button

and it wont backfire on apple seeing as its THEIR patents

I will say that out of all the manufacturer installed custom Android UIs I've seen, Samsung's is the closest to imitating iOS.

$200 for a dual core 1 GHz beast, $200 for a wimpy 750MHz single core from 2010. Clearly not overpriced at all.

I'd watch ****ing with Samsung if I was apple considering they make most of the hardware for the biggest Apple moneymakers- iPhone, iPad, iPod Touch, etc.

Most android smartphones don't have that big central button on the bottom (they usually have three or four evenly spaced buttons). That's clearly there to make it look more like an iPhone, and from what I've heard it comes at the expense of making the phone a bit cumbersome comparatively. And usually you have a app drawer button on the bottom of the home screen, with an additional two or four software buttons surrounding it. That row of four icons again gives it a more iPhone like feel.

As long as they didn't use tech under copyright...Samsung should be okay. It's a common shape and they can't copyright that.

You got to admit they do look nearly identical, and yes apple products are pretty pricey but I dont mind paying that for the quality of the product they make and the other services they have such as the app store

There's a point there.... but the mere fact that many companies decided to start selling these touch devices shortly after Apple did.... that's just lame.

They can patent a generic design of a full screen with touch buttons?

The design may seem somewhat generic now, but that's only because manufacturers started to copy design elements after the iPhone came out. Even still they usually gave their products some distinctions. Google also tried to make Android distinct. Yet here we see Samsung tweaking the standard Android UI so that it looks even more like Apple's product.

patents can be tricky.. if not worded perfectly or if it is too broad or too specific loopholes can easily be found. this becomes even more a problem if a trial ends up going to a jury of people not familiar with the technology and are left to decide upon it.

The Ipad and the Iphone were not the first tablets.. I fail to see how they can have the patent on it.

I'm not going to bother addressing the iPad... It is irrelevant at the moment. What matters is the iPhone. While no, it wasn't the first pocket size tablet device (aka a PDA), nor the first smartphone, compared to the Palm and WinMobile devices that had existed the iPhone was a pretty radical departure. It ditched almost all the physical controls and stylus input that had been the convention. It popularized multitouch and gave us the first decent onscreen keyboard. And notably it put greater emphasis on the home screen than their had previously been.

The only real news behind this is that Apple spent something like $5.7 billion dollars piecing out their components and is now suing them. Patent lawsuits are nothing new, and certainly not exclusive to Apple. Obviously this thread is meant to throw dirt in Apple's face...It's nothing new from you.

As long as they didn't use any copy righted tech, there should be no case here. It's pretty stupid that Apple can sue just because another product kind of looks like theirs. Maybe Nintendo should sue Sony because the original PSP looks kind of like a Gameboy Advance.

Change the theme and completely custimize the UI, use alternative programs, such as, browsers, mail clients and music players. run third party applications, or applications that haven't been "approved". basically if your unhappy with the way the something is, you can change it. Now you can also do all of this with the Iphone if you jailbreak it, but I don't want to have to wait for a new hack every time a new firmware is released or have to wait for an app to be updated to run on the new firmware, specially when all I have to do is just use an android device.

Poweramp, Player pro and songbird aren't too bad. It just seems to get all the features I want, I have to use 2 or 3 players. And I have yet to find a player that can read the embedded ratings of my mp3s.

When I found out that you can get Opera on Android, I was elated. The browser on my phone is s*** (barely lets you do anything, or is it easy to use, feels like it is designed for a computer, not a phone). I won't ever use the default browser again on my phone... I'm still playing around with the new FireFox browser (which syncs with all FF's on desktops that you have an account on) but it is a RAM hog like its desktop counterpart, so it slows my phone down (but it will be great for newer phones with more RAM). The iPhone is far too restrictive, and honestly, is crap compared to Android devices. It goes little beyond a fashion statement now. Android is to the iPhone as the PlayStation was to the N64. It opened up a whole new bucket of possibilities that just couldn't be achieved on the highly restrictive Nintendo platform.

When I heard Mozilla was making a mobile version of Firefox was when I really started getting intersted in Android. Firefox is ok, it's nice that I can sync my bookmarks with my desktop version, but as of now, I prefere Opera Mini.

Yea, I'm a lone dev right now, actually trying to put together a team. But, I'm just starting on other apps and the planning stages. Poweramp is what I was using for quite a bit. I figure I will have to do some more research to design all the functionality/features a little better as my plan is just at brainstorm phase.

Interesting. Doesnt Samsung manufacture alot of the parts in Apple notebooks, iPods, iPhones, iPads, etc.?

When I found out that you can get Opera on Android, I was elated. The browser on my phone is s*** (barely lets you do anything, or is it easy to use, feels like it is designed for a computer, not a phone). I won't ever use the default browser again on my phone... I'm still playing around with the new FireFox browser (which syncs with all FF's on desktops that you have an account on) but it is a RAM hog like its desktop counterpart, so it slows my phone down (but it will be great for newer phones with more RAM). The iPhone is far too restrictive, and honestly, is crap compared to Android devices. It goes little beyond a fashion statement now. Android is to the iPhone as the PlayStation was to the N64. It opened up a whole new bucket of possibilities that just couldn't be achieved on the highly restrictive Nintendo platform.

but ive yet to see one of these possibilities on andriod that will draw me away from my iphone the when my contract run out soon. ive yet to see this defining feature that makes as you say the iphone crap compared to androids. what am i missing. im no apple fanboy the iphone is the only apple product i own and chose it because i thought it was the best i had looked at.
