like if someone found their photo on awkwardfamilyphotos.com/peopleofwalmart or another site where they post funny pics of people could you actually get in legal trouble?

Probably. Who knows because it seems like with enough money and a good lawyer any shmuck can sue anyone for just about anything.

Such laws are location specific, for the political boundaries in which the photo was taken, and the associated property rights of the physical space. http://www.google.com/search?q=public+photo+rights

Watermark it if it isn't already and say they stole it from your site, otherwise give credit where credit is due, and either post a link instead of the pic, or at least provide information about the source.
