WASHINGTON - Pot-smoking patients or their sanctioned suppliers should not be targeted for federal prosecution in states that allow medical marijuana, prosecutors were told Monday in a new policy memo issued by the Justice Department.

Under the policy spelled out in a three-page legal memo, federal prosecutors are being told it is not a good use of their time to arrest people who use or provide medical marijuana in strict compliance with state law.

The guidelines being issued by the department do, however, make it clear that federal agents will go after people whose marijuana distribution goes beyond what is permitted under state law or use medical marijuana as a cover for other crimes.

The memo advises prosecutors they "should not focus federal resources in your states on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana."

The new policy is a significant departure from the Bush administration, which insisted it would continue to enforce federal anti-pot laws regardless of state codes.

"It will not be a priority to use federal resources to prosecute patients with serious illnesses or their caregivers who are complying with state laws on medical marijuana, but we will not tolerate drug traffickers who hide behind claims of compliance with state law to mask activities that are clearly illegal," Attorney General Eric Holder said in a statement.

Fourteen states allow some use of marijuana for medical purposes: Alaska, California, Colorado, Hawaii, Maine, Maryland, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont and Washington.

California stands out among those for the widespread presence of dispensaries — businesses that sell marijuana and even advertise their services. Colorado also has several dispensaries, and Rhode Island and New Mexico are in the process of licensing providers, according to the Marijuana Policy Project, a group that promotes the decriminalization of marijuana use.

Holder said in March that he wanted federal law enforcement officials to pursue those who violate both federal and state law, but it has not been clear how that goal would be put into practice.

The memo spelling out the policy was sent Monday to federal prosecutors in the 14 states, and also to top officials at the FBI and Drug Enforcement Administration.

The memo written by Deputy Attorney General David Ogden emphasizes that prosecutors have wide discretion in choosing which cases to pursue, and says it is not a good use of federal manpower to prosecute those who are without a doubt in compliance with state law.

"This is a major step forward," said Bruce Mirken, communications director for the Marijuana Policy Project. "This change in policy moves the federal government dramatically toward respecting scientific and practical reality."

At the same time, officials said, the government will still prosecute those who use medical marijuana as a cover for other illegal activity.

In particular, the memo urges prosecutors to pursue marijuana cases which involve violence, the illegal use of firearms, selling pot to minors, money laundering or involvement in other crimes.

And while the policy memo describes a change in priorities away from prosecuting medical marijuana cases, it does not rule out the possibility that the federal government could still prosecute someone whose activities are allowed under state law.

The memo, officials said, is designed to give a sense of prosecutorial priorities to U.S. attorneys in the states that allow medical marijuana. It notes that pot sales in the United States are the largest source of money for violent Mexican drug cartels, but adds that federal law enforcement agencies have limited resources.

Medical marijuana advocates have been anxious to see exactly how the administration would implement candidate Barack Obama's repeated promises to change the policy in situations in which state laws allow the use of medical marijuana.

Soon after Obama took office, DEA agents raided four dispensaries in Los Angeles, prompting confusion about the government's plans.

I don't smoke, but medicinal marijuana has it's place, so long as it stays controlled for those people and those people alone to use it, I'm all for it.

It is about time.

Pot has quite a few great uses in the medical field. It can be good for chronic pain patients, anxiety patients (like me granted I don't go to therapy for my problem), insomnia patients, etc...

Pot is MUCH safer than the prescription drugs we hand out.

The only way it does damage is through prolonged and very heavy use. I honestly view weed as less-destructive than cigarettes. Instead of getting cancer the worst you can get with weed is memory loss after years and years of heavy use.

Prescription drugs on the other hand can have loads of side effects some of which can be deadly. They can also be highly addictive (mainly painkillers) at times unlike marijuana which does NOT have any real physically addicting properties.

It has taken way too long to be allowed for medical use. Instead of prescribing patients sleep meds which were causing cases of sever sleepwalking maybe we can prescribe this relatively harmless herb that puts them to sleep, lets them get a good sleep, and doesn't have them sleepwalking.

I'm equally baffled. I think they mean they're going to stop hassling them for documentation and the like as long as they have the correct documentation and the like. Makes perfect sense.

Medical marijuana is still illegal under federal law, and it was common practice under the Bush administration for the FBI to raid and shutdown state approved medical marijuana distributors in states that allow it. This is a reversal of that policy.

I think the government needs to do more on this issue and make it where every state allows medical marijuana. It is a much safer natural drug compared to other synthetic prescription drugs out there. But this is a step in the right direction

And just an FYI, it isn't pot but prescription meds that can bring about schizophrenia. A friend of mine had to be taken off ritalin after it had her hearing things and then consertia after it was making her see things.

Anyway, this is good as long as they're only allowing medical marijuana use and not recreational use. Common sense, it seems.

It was legal under STATE law. Under FEDERAL law, it was still illegal. Here in CA at least, the medical marijuana law contravenes federal laws and the two are in conflict. The DEA has raided dispensaries here a handful of times since medical use became legal.

Somebody should be policing the corrupt doctors who are tossing out the medical marijuana cards willy nilly. I mean look at this halfwit. Hardly a sufferer, and probably going to be a leech on society's ass when he matures enough to string together a sentence in less than a minute too, which, at his rate, isn't going to be any time soon.

Thank God, it's about time they take a step in the right direction. This is one thing I can agree with Obamer on. Legalize and decriminalize it!

There are millions of individuals who need this for medical help and they ALL are thanking the heavens for this little bit of relief.

Educate yourself on marijuana and hemp, don't be a lock-stepper.

I don't mind it. I don't think arresting patients acting legally under state laws is getting anywhere when it comes to the drug issues in this nation. They are still going to arrest folks using state laws as a cover for larger illegal work. Also, hey it is deference to states rights. Some conservatives should be happy about that.

Absurd. The laws are in place for a reason. The government should enforce them. Marijuana is stain on our culture, and we should do everything we can to end its use. I seriously can't believe this.

Do you have a point?

Pot has differnt affects on everyone 1 person might be ok, while another person might become depressed or be a psycho. It has to do with your genes. If you had to legalise pot they would have to analyze someone's gene before they can take the drug.

Yeah, I think his point is that long term use of any mind altering substances can lead to psychosis, and pot has a particularly long lasting association with schizophrenia and psychosis. Your grounds for calling BS are...?

Yeah medical marijuana , as far as I've heard, does not actually help the patient. But I don't care that much. If these dying people want the black lung too, fine by me, their choice. Just don't get it near innocents.

Pot has differnt affects on everyone 1 person might be ok, while another person might become depressed or be a psycho. It has to do with your genes. If you had to legalise pot they would have to analyze someone's gene before they can take the drug.

That isn't pot your friend just turned out to be a bad person. Pot has no such effects on ones personality.

The only way pot changes people is by impairing their coordination and making them want to relax and eat alot. Heavy use over long-periods leads to memory loss, thats about it.

You obviously need to go educate yourself on the subject if you think pot can in any way lead to mental illness....

And just an FYI, it isn't pot but prescription meds that can bring about schizophrenia. A friend of mine had to be taken off ritalin after it had her hearing things and then consertia after it was making her see things.

One of my old friends took opt, nows he's a murderer and a rapeist.

My dad tried heroin, and now he's a successful lawyer. See what i did there? You think maybe, just maybe people control their own decisions, and your friend chose to be a murderer and rapist? I highly doubt that marijuana forced him to kill and rape.

Yeah medical marijuana , as far as I've heard, does not actually help the patient. But I don't care that much. If these dying people want the black lung too, fine by me, their choice. Just don't get it near innocents.Pyro767
Absolutely not true. And smoking cannabis doesn't automatically = lung cancer. Also, there are ways of using it without smoking that completely eliminate the lung damage factor.

Yeah, I think his point is that long term use of any mind altering substances can lead to psychosis, and pot has a particularly long lasting association with schizophrenia and psychosis. Your grounds for calling BS are...?

My grounds for calling BS are the lack of evidence suggesting pot can even POSSIBLY cause a mental illness. Notice not one piece of evidence has been brought up into this discussion?

Pot is pretty harmless. Theres a reason it is so sought after for medical use. It is a TON safer than the ridiculous prescription drugs we have out there. I am still wondering how it is even freaking legal that Ritalin be on the market. That drug has such AWFUL effects on the body. I cannot believe it is given to kids.

I am so glad I took myself off of it after only a little while on the prescription especially with what I know now. You actually aren't even allowed into the military here in the States if you have ever taken it after the age of 12. Heres a funny thing, apparently they have found high rates of childhood stimulate use (AKA Ritalin) among people diagnosed with Schizophrenia and/or bi-polar disorder.

Their onsets are typically much earlier than normal and family mental illness history serves for no real indication in this case, which is very interesting considering both are mental illnesses KNOWN for being a genetic thing, meaning that these drugs could very well be the CAUSE of the illness and not even some mere trigger.

BTW I should also mention that several of these effects they attribute to ritalin I have despite having only been on it for some months which makes me wonder if it could actually be the cause of them....

But back on point, people need to give some real, legitimate reasoning as to why pot shouldn't be allowed for medical use AT THE LEAST. Nothing should be illegal without STRONG reasoning and PROOF as to why it shouldn't.

It is what I know of the drug.

I have yet to be shown any substantial evidence of marijuana having any real negative effects besides memory loss after years and years of heavy use.

I find it to be less harmful than cigarettes....
