I got a possession of alcohol under 21 charge , Questions.

Ok So I have court 2morrow, failed to consult a lawyer to even ask how it all works. I noticed its a different Courtroom than the one you go for a traffic ticket. So whats up, I have a ticket for possession only, not under the influence, Its my first ticket for anything , I'm 19 years old have no record of nothing bad. Sooo What can I expect? Can I ask for a extension so i can get a lawyer, or can I plead for prayer for judgement? Since its m first offence and not planning on commiting it again. Will I have to do any community service ? Btw. I live in North Carolina. Soo anyone that had a ticket for this can you please let me know ur experience? thanks in advance

If you got a clean record, more likely than not you probably just get slapped with a fine for a couple hundred bucks.  I wouldn't worry too much about it.

Sorry, that was probably unnecessary, but it varies from state to state. The odds that somebody on here now is from North Carolina and either a lawyer or has been in the exact same situation are somewhat slim.

what about prayer for judgement,does that work?i also hear it can backfire on you,which is unlikely but it can happen

Allot of times the prosecutor will come up to you before the hearing and offer you a deal for pleading guilty. Take the deal. If you plead not guilty you better have some type of lawyer.

ask for community service with a petty misdemeanor charge.  It won't stay on your record or at all if you get it changed to that. 

All you have to do is not be a **** to the judge, and tell them you're sorry.  Most judges won't be hard @sses and will give you the minimum penalty which is a fine and a wiped slate.

well Prayer for judgement supposebly lets you off the hook if u have a clean record and dont do anything wrong for a year, i may be saying it wrong but thats what i heard, plus u can only use it once.

actually i got handcuffed and put in the back of the police car, I was very drunk and quickly admitted i was 19 when he asked me. I was outside of a party when all of this happened, the officer sked for my information but didnt ask me for ID or anything. I was really scared and kept saying i was sorry and stuff, later on the officer went in and talked to one of my friends, he confirmed my name and came back, He just let me go with the possession of alcohol charge, atleast thats what i think, i mean i wasnt breathtalized or nothing and in the ticket it says possesion of alcohol tequila cuervo only

DO NOT plead guilty. plead no contest. that way it can't be used against you again for something else. most likely you'll just get a fine. does it even say that your court appearance is mandatory?darkjedirpm

I think it did, I lost the ticket(crazy night) but I went up to the courthouse and double checked my court date. also the ticket doesnt show any amount of money so i assumed im supposed to show up to court mandatory

I was in the passsenger seat of my friends car ( car off) looking through hes ipod with  the car's audio on, Tequila bottle in between seats, I was really drunk, apparently they got a call for the loud music from the party and well I got screwed since they saw me first thing once they walked to the house.

you will probably get a diversion which means that you will likely need to attend alcohol classes and upon completion with possibly some extra time...you will get it wiped from your record. this happens everyday...it's not THAT big of deal. be respectful, be polite, and dress nicely (nice shirt with a tie). if you do those things, you will get a fine, classes, and nothing else. don't worry...unless the judge is less than a decent person.

edit: if fact there will be no legal record of it....so really there is no way that a record could be wiped. 

are you sure you didn't just get busted for open container?  I think it's about the same thing they'll fine you about $100 or so.  When one of my friends got busted he aranged for community service since he had to do it for his frat anyway.

Something you might try is if they were arresting alot of people that night they'll probably try to get them done in one day.  You have the right to change the court date if it interferes with anything.  In doing this you can luck out and hope the officer who issued the ticket will forget about you and you'll go free (or at least that's how it works w/ traffic tickets sometimes).

well yea it said openned tequila bottle but it stills falls under  the under 21 catagory, also can u change the court day on the court day? since its actually in 6 hours, its 2 am here. the date can be postponed in the event of an emergency (among some other rare instances).  at this point you must go unless something major comes up...and it looks more positive to show up when the court deems.  It lends to one's responsibiliy level which is a good thing to most respectable judges.  You'll look all the better for it.

you can try, but if you can't just tell them that you're a good kid (they can see that from your record) and that you had made a mistake. i see that you are working, if you're in school as well that could work in your favor. fight the power man! :P

Just give up!  Start drinking and go to court wasted.  Be as rude and repulsive as you are capable of, and then tell the court it's one of your better days, then belch loudly and laugh, and then grope at any female nearby.
