I was on Interstate 95 in MA going 80 in a 55 (according to the cop). He clocked me and estimated and then pulled me over about 50 ft away from my exist. He gave me a ticket at midnight for speeding. I'm 18 and I've had my license for about 5 months. The ticket is for 200$.

I have no idea how fast I was going, but it wasn't that fast since my exist was RIGHT THERE and no one else was going 55. What do I do? Should I appeal it or pay it? If I pay it, what will happen?

Im sure he wouldn't have gave you that outlandish 80 as your speed if you weren't in fact, speeding. Pay it. If you don't, after a certain amount of time there will be a warrant for your arrest.

Thats probably a few points on your license since you were going 25 over which is pretty major. If you fight it and lose i think you just end up paying a higher fee because of court fees and unless you have some pretty good proof, the judge will not take your word over a cop. You can try and ask if the radar was calibrated recently but if you were in a 55 zone and he said he got you on radar or laser at 80 your pretty much boned.

Yeah, you're right.. you weren't going 80.. the cop lied.. for no good reason other then that he just didn't like you.

Step up to the plate and accept some responsability here.

Be happy you got away with a ticket. You were close to the point where they would have simply revoked your license as well.

Coincidentally, I got nailed with a speeding ticket myself last night. I forgot it was the end of the month and didn't realize that the area I was traveling through was a speed trap and ended up getting pulled over by two cops for going 16 MPH over. I only have to pay $160 though (which is aggrevating since if I had been clocked 1 MPH less that fine would be $135 instead).

Protip: If the cop doesn't show up on the day your hearing is, your case gets thrown out. Nine times out of ten that won't happen, but it's worth a try.

I was going a LITTLE faster than the flow of traffic, but I was in the left lane and by the time he had pulled me over, I was going slower than everybody.

IT doesn't matter if you were slowing down.. it only matters where he clocked you at.

I'm pretty sure you can appeal it and as long as he really wasn't pissed or was lying he won't show, and your off the hook. If they come then your screwed more I think.

Appeal it. Can't hurt, but people rarely win those unless they actually have proof of something. Don't really have any proof that you weren't speeding. It's a kangaroo court. Pay it and suffer like the rest of us that get screwed by the justice system.

*smashes head against table* FML. Thanks though guys. Is going 80 a ridiculous speed? I got about 80 everyday, but, in doing so, I'm keeping up with the flow of traffic.

You can appeal and go to court. If he doesn't show, the ticket gets thrown out but you pay court costs. If he shows, you'll lose and pay the ticket. Win or lose in court, you still have to pay for the court cost which is usually more than the ticket is worth, so it is a lose-lose situation. If you really weren't speeding you can try and fight it for the satisfaction but if this is a monetary problem, you're better off paying the ticket. You can also go to trafficing school to remove any points you have on your license.

Hope that helps.

Yeah, theres another thing.

80 on a normal day is fine on a highway. Most people do 80 anyways.

It was a clear, winter night. It was midnight, I literally JUST got it (lol I the first thing I do is post about it on GS!). There was no ice on the roads (that I knew about) or snow or anything. It was clear and cold. And dark, but I had my lights on.

dispute it. The worst that can happen is you have to pay the ticket. You will either get a reduction or a total dismissal.

If the guy who gave you the ticket is there for traffic court ask for a reduction, if not dispute it fully. Its a tried and true method.

Do you have the ability to redeem yourself through traffic school? When I got a speeding ticket they said they would remove the insurance penalty if I took 8 hours of traffic school. Traffic school is boring as hell, but it's so worth it.

Also:

If you show up to court for an objection to the traffic ticket and the traffic cop who gave you the ticket doesn't show up to court, you're free and have your counts removed from your record. It's totally legal.

just dispute it, you have nothing to lose i got lucky for the only ticket ive gotten... i was doing 120 mph (in a 55mph zone) but i saw the cop before he saw me, and slammed on the brakes... he clocked me at 101mph so it was still "reckless driving" (misdemeanor) and a hefty series of fines but it could have been worse

Protip: If the cop doesn't show up on the day your hearing is, your case gets thrown out. Nine times out of ten that won't happen, but it's worth a try.

gameguy6700

Typically the date the cop writes down on the ticket to be in court is that cops 'Court Day', where he's at court all day. All the people he gave tickets to for a that week all come to court on the same day, because that's the day the issuing officer will be present.

Yup. And you're even worse off in smaller towns/communities where they'll assign one or two days out of the month for traffic tickets. The county court I went to for my ticket had their "traffic ticket time" starting directly after their "domestic dispute time" which was awkward (since I arrived pretty early) to say the least. Cops and officials are even more certain to be there since it only happens once or twice a month.

Both of you seem to have missed the part where I said "9 times out of 10 that won't happen". I was saying that the cop is in all likelihood going to be there, but there's a small chance that some extinuating circumstance may pop up that keeps him from showing up. It's rare, but some coworkers and friends of mine have had it happen before so it's not impossible. Basically you're gambling that the cop is going to get really sick that day, get in an accident, or that some sort of family emergency is going to come up.

I'm not sure how it works in your state; I assume it is different for every state. I live in CA, and if you get any type of driving violation with points on your license, you have to go to a legitimate traffic school to remove the violation points. The reason this is really important is because you will most likely see a bump in your insurance payments because the insurance companies see the violation points and say, "Hey look at this guy, he's more likely to be in an accident due to his careless driving, so in order to keep our company out of the red, we'll charge him more every month." I know it sucks, but put in the hours for traffic school and get those points removed. It's better for you in the long-run.
