Last time I checked, having sex with someone who is unconscious is rape.

And it's grossly inaccurate and absurdly prejudiced to say that people in the third world regularly use rape as a way to "get laid." Most people, even outside of the first world, are not rapists.

The judge is only following the law. The law says it isn't rape so therefore he can't accuse him of rape. He doesn't have the power to change the law.
