Ohhh boy...Not only are no injuries listed...But this is being posted 5 years after the fact.

Ann Soderman says that on December 1, 2004, while seated at a dining table at Wildfire Restaurant, a waiter dropped a large plate that struck her wrist.

According to the complaint, the waiterand restaurant were negligent when he, among other things, "failed to secure the plates while carrying them" and "attempted to carry more plates than was reasonable safe and prudent to do so."Excerpt

FYI - The jurisdictional limit of Law Division in Cook County is $50,000, I believe...So she wants more than that.

People in the country try to sue for too many stupid things. I can understand if there is substantial loss or change of life but this is just insane. She should see a Doctor for this rare disease she has. It must be a time delay type thing where she doesn't feel the impact of things to much later. I am sure in a couple of days she will feel the pain of someone steping on her foot on New Years Eve 2005

That's a ludicrous sum.

The manager of the cinema I used to work at was forced to shell out for a new pair of shoes for a customer who spilled his coke over himself and blamed it on the staff. There were even cameras which would have clearly shown what had happened, but getting the guys from security to come in and look at the tapes would have cost more than the 100-odd quid the guy was demanding. Big companies almost always cave in to petty claims like that because it's just not worth the hassle or the publicity.

I could see something if she's now injured do to the incident where it only appeared recently, but for years ago...she probably doesn't even know the waiter's name, which would just turn into a 'he said she said' type of situation.

That's the beauty of this, though...The individuals don't get sued, the company does. It doesn't matter who the employee was at all...And yeah, he's probably not there anymore anyway.

I didn't think you could file a claim five years after the fact :?

There really needs to be some changes in the legal system to stop this abusive suing. Just some basic rules about time requirements, or minimum injuries sustained, etc.

I agree, but it's these type of stupid lawsuits, that also improve the quality of service. Let me tell you, in Africa where you can't sue anyone for anything, customers get treated like crap. In the US, even though people abuse the system way too much, atleast it forces the companies to be more careful and handle it's customers with care and dignity. I'm not saying I agree with these idiotic lawsuits, im just saying having a system where you can sue for anything is better than having a system where you can't sue for anything.

People who bring such frivolous lawsuits should be jailed or put to work. Seriously, its a waste of time, money and shows how pathetic people can be.

Unclear from the original statement...I'd imagine she is claiming wrist problems now, so she probably has a doctor ready to say how this one incident caused damage blah blah blah So, in short: I don't know...But it's still ridiculous.

Why do the american courts put up with this? These people need to be fined and jailed for wasting the courts time trying to exploit any loop hole they can get for easy money.

I remember the good old days. Back when having a plate dropped on you, getting hit by a car, having hot coffee spill on your lap, etc. was considered a bad thing. These days - thanks to trial lawyers and our government which caters to them - it's the best thing that happens to some people.

So wait, what is the justification for the lawsuit? Was there phyiscal injury preventing them from doing something? Legitimate emotional scaring?

Hmm...it doesn't seem like the plate harmed her in any way so it seems pointless to sue. Accidents happen...One of my dads friends was at a restaurant and they spilled water over him on accident of course.

Yeah this one is lol. Now lets get some things clear here - just because a lawsuit is filed, doesn't mean anything will happen. Most of these are going to be settled out of court or through arbitration. Let's not get our panties all up in a bunch.

How dare you tell me what to do with my panties :x Even if settled, though, the point remains that stuff like this only degrades society.
