school/facebook unfair punishment

So this kid keeps provoking me and a bunch of friends by calling us out on facebook, but never to our faces. eventually a lot of my friends went off on him from one of his status's and everyone has been called down to the office for it. Im the only one that got 2 saturday detentions out of everyone else and all i did was curse at him. everyone else did to plus they threatened him! but even so, can the school suspend you or punish you in anyway because your arguing with someone over facebook? i mean if i said i was going to beat him up the next day at school thats one thing. but we didnt say anything like that. nothing took place in school at all. what are your views on this?

Facebook is a public website. All information and opinions posted on it are also public.

The school has the right to use them if the information if it in ANY WAY may disrupt the learning environment for any student/students.

they cannot, its completly illegal, the school does not have any authority above you if you are not inside of its property or wearing its uniform...therefore its illegal that they punish you at school for doing something in facebook...im serious when I tell you this: go talk to the principal tell her you will get a lawyer and sue their *****

No way man. Some kids from my school hacked onto this girls facebook and went through her messages and all that and the girl took it to the headmaster and he said that he couldn't do anything about it because it was not on school grounds. One of the kids who hacked onto her facebook happened to be his nephew but the point still stands!

There are cases all over the US of students being punished for "critizing teachers in vulgar ways" and so forth.

Because anything that interrupts the learning environment can be brought in school.

Technically, they aren't allowed to do anything because it is not on school property. Once you are off campus, they have no authority over you. That doesn't stop them from doing it though. No one has really stood up to fight against it, since it is not worth taking something to court when the punishment is just detention. Schools can get away with it really easily. With that said, you really shouldn't be insulting someone on a website in public like that anyway. There is a reason why you can send private messages. Because while schools aren't supposed to be allowed to do that, employers are. And what kind of a school gives you detention for cursing at another kid? Do you not go to a public school?

Schools can intervene only when there is a clear and present danger posed by students' speech. In Latour v. Riverside Beaver School District, a student was expelled for rap lyrics he posted on the grounds that they seemed threatening; the court found in favor of the student, and the school was forced to change their policy. On the other hand, in Weedsport Central School District v. Wisniewski, a student had created a picture with a gun to a man's head and the text "Kill Mr. VanderMolen" (one of the kid's teachers), and the court found in favor of the school, as they concluded it constituted a genuine threat.

In this case, I can't imagine how this could possibly be considered a threat, and as such, I would be surprised if the school won if they were taken to court.

There have been lawsuits over this matter and it is within the schools rights to punish you for this. In fact, my friend got suspended for calling a girl a b**** and his parents sued the school and lost.

Having worked in public schools for five years, tell you where this is all coming from. If a school official (teacher, administrator, etc) has any knowledge of a child being bullied in any way (and yes, cyberbullying is still bullying), he or she is required to act upon it; a colleague of mine is currently getting sued because he possessed knowledge of a student being bullied and didn't do anything about it. People keep crying out for us to do more about it but then get mad when we do. Damned if you do, damned if you don't.

"Technically, they aren't allowed to do anything because it is not on school property." Thats not true at all... Around here if you get into a fight outside of school(with someone who attends the same school) you both can be kicked out for fighting.

I think the general feeling was something along the lines of it potentially disrupting school and its the teacher's responsibility to report bullying regardless of where it happens. It was a teacher that he was facebook friends with that reported him.
