Plus within the X-Men films, mutants generally seem to be hidden away in society and not be nearly at the power level of any individual Avenger (except for some of the main ones in the main team, like Nightcrawler and Wolverine), so there's no reason they can't exist in the same universe when they do in the comic universe and its only a matter of licensing that keeps any appearances away.
I also like to imagine that while the big battle was going down, Spider-Man was too busy in High School or College all the way at the other side of Manhattan to help.
