speeding ticket advice needed!

i recently got a speeding ticket in NY for 70 in a 55mph. now i realised after the fact that the cop said i was speeding in a "posted work zone" although he clocked me before i even reached the work zone and pulled me over after it ended (i was going 50mph through the actual work zone). i live about 2 and a half hours away form where i got pulled over, should i plea guilty and get it over with or should i try and fight this and how would i go about doing this?

edit: the cop was a state trooper i don't know if that makes a difference, also i forgot to mention i live in NY too. also im 19 and my dad's pretty pissed about his insurance increasing

Yeah, go ahead and try to appeal it. You're going to lose. Going against cops over speeding tickets is never a good idea.

What evidence do you have that you weren't in the work zone? Or is it going to come down to your word against the cops? Think about it.

And how the hell is he going to prove that? Do you know what cops do? They sit on the edges of the work zones, radar your bum, then pull you over while you're in it.

Look, people, it's ALWAYS a good idea to show up in court looking nice. You almost always get a reduced sentence, and more than likely can get a PBJ, regardless of the violation.

Dude he was going 15 mile over the speed limit. He didn't steal a car. Suck it up and pay the fine. You're going to have to appear in the court of the county the speeding ticket came from.

Depends, is it worth the hassle for you? Some people here are going to get all high and mighty and say "thats not the point! Its the principle behind it! They were wrong, you shouldnt have to pay! Cops shouldnt abuse their power", In honesty, I wouldn't give a damn about the principle. I would just pay the damn ticket and get on with my life, no point creating more hassles in my life over such a minor inconvenience. If it means that much to you, appeal it, if it were me, I would just let it slide. I have better things to do than appeal tickets :P

Just go to court and admit to going over, but not in the work zone. I assume that its double fine if your in a work zone everywhere in the us. You really need to stop listening to Sammy Hagar on driving advice, you CAN drive 55!

probation before judgment means no points if you don't get a violation down the road within a time period

It seems its just easier to plead guilty and pay the fine... it just a hassle having to go thourgh court and what not..IMO of course...

I don't know how it works in America but in Canada, if the cop doesn't show, you get cleared of charges. You're better off showing up just because he might not show. Then again, cops tend to show up for speeding violations more than any other. Sometimes, its just luck of the draw.

Why is a lessened penalty an unfortunate?

It instills the thinking that you can break the law and if you go through some paperwork you may get off or not be punished as much as you should.

Maybe the letter of the law is stricter than it needs to be and they allow it because there is a process to get the correct punishment. Going to court is a punishment, and you still have to pay court fees and whatever is left on your ticket.

If you werent exceepding the Work area speed limit then you are innocent on that and should appeal and hopefully the cop is honest and you get reduced sentence, just make sure your correct and plan what to say, you dont want to look like a fool in court.

I'm not going to debate the validity of laws and punishment...but it's gotten to the point that the first thing a person thinks of when they get a traffic ticket is, "I'm gonna go to court and get this overturned." not, "Well, I was breaking the law and I got caught. I will learn from this mistake." It seems like everyone has 49 reasons why they shouldn't be punished, instead of taking the blame for their actions and accepting punishment. If one received a ticket and you can prove the the officer was wrong in giving it to you, then you should appeal it...unfortunately, people think that anything can be used as an excuse.

I never received a ticket I didn't deserve. I'll tell you what the first cop who ever pulled me over said: "Always go to court." A Maryland State Trooper. Always go to court.
