This sounds like a sequel to A Time to Kill.  I can understand the man's rage, but he still committed murder.  He should be punished for it regardless of what John Grisham's novel says.

Still not murderous intent. They went out driving to have fun or get somewhere, not kill someone. Which doesn't make them evil. We all understand the mans rage, but civilized people don't get revenge by killing people.

100% correct.  The only thing worse than the sons dying, is the murder of the driver.  

One was accidental, the other intentional; I think the latter should be punished severely.

He killed someone, he should be charged with murder. Laws wouldn't mean much if we frequently said, "well I guess I understand why he did it so this time it's ok".

I got arrested a few months ago for stealing from the place I worked at. They treat their employees poorly, lied on our evaluations for years, screwed up our schedules, didn't give me the vacation time I was supposed to have three years in a row and wouldn't fix it, because of that and more I don't feel bad about stealing from them but at no point was I dumb enough to think a judge would let me off if I told him that it's ok because they were all ******* and deserved it anyway.

You can't give people special treatment because they had or thought they had reason to break a law, it would cause a hell of a lot of problems.

If you intentionally kill someone for any reason other than defense then that is murder.

Maybe a reduced sentence for the circumstances, but prison time is definitely warranted and should be given

Not that I condone his actions, but I probably would have done the same. If some drunk killed my children right in front of me, regardless of intent, I don't think I'd be able to control myself; I don't think many people could.

Anyways, Who wants to bet that he gets off by pleading temporary insanity?

While I'm sure that it would be almost unbearable to lose your sons to a drunk driver, we dont live in a country where vigilante justice is acceptable.  The courts, not this person, should determine the fate of the drunk driver.

Generally people in civilized society (or perhaps.. people with low testosterone) make efforts to resist many of our emotional urges, especially when those urges involve killing someone and going to jail.
