today after school, i see this kid dogging me down. so i ask him why the hell hes staring at me and we get into a little beef. we exchange words face to face until security arrives. it wasn't even that big of a deal, but our school is lately paranoid after racial issues over the past few days. i didn't think it was gonna be a big deal, but they searched my backpack of its entirety and looked through basically everything. they are even sending me to court and a fine up to 400$.

were they legally allowed to do this?

no, they didnt find anything. they're sending me simply for "disturbing the peace". absolutely ridiculous. the whole incident was maximum 2 minutes.

Well, tell the courts what happened and get off on nothing. Let them waste their money on a lawyer, heck, an appeal like that you can dodge. It's not as if Dog the bounty hunter is going to come after you for disturbing the peace. But then again you can get free time off school :).

No, they were not. They do not have the right to search your belongings without a warrant.

To all the above posters, they can legally, because you have NO EXPECTATION OF PRIVACY. It's the law. You are stated, explicitly, that you do not have privacy in your lockers, so therefor, IT IS NOT PRIVATE. It is not illegal. They can search under any sort of suspicion.

And my friend swore and got a disturbing the peace, so they'll probably nail you on that. :(

Yes, but they searched his backpack, not his locker. His backpack isn't school property.
If I were you, I'd give the school trouble about it just for the hell of it.

i don't believe that that has held up in schools, i believe it was taken quite far when they found drugs in a kids locker and the school won.

I know it's state law at the very least that it's legal to search anything in your locker.

EDIT: i should say, under suspicion of activities. Not under probable cause or anything like that, just the suspicion:

Not without a reasonable suspicion that would justify the search. Students have a reasonable expectation of privacy in their purses, backpacks or other containers inside their lockers. This means that there must be a reasonable suspicion to justify the need to touch the outside of the container. Courts have held that governmental interest in keeping order and preventing danger can outweigh students' expectation of privacy in some situations.

For example, the fact that a school security officer heard an unusual metallic thud when a student's book bag was flung down, suggesting that it might contain a weapon, was sufficient justification for an investigative touching of the outside of the bag. The government's interest in keeping weapons out of schools outweighed the student's expectation of privacy. Can school staff search backpacks

EDIT 2: full quote.

They can only search school property. Don't quote me on that, but I'm fairly certain that's true. Unless your backpack was school property, I don't think they can.
