I may be wrong, but I think you can get a DUI even if you're on a lawn mower.

i think the main reason he probly got arrested was for obstructing the traffic behind him that or maybe a dui or a mixture of both i dunnofl4tlinedIt's not illegal to drive a tractor on the road, actually.

either way, it was bogus. Got pulled over b/c my passenger didnt have his seatbelt on. Everything was fine, "yes ma'am, no ma'am" I said, she was polite and it was routine. I wasn't pulled over for swerving or driving erraticaly.
But on the way back to my car to deliver the ticket to my passenger, she saw a case of beer and a few bottles of wine in the back of my truck and suddenly it was "Sir, step out of the vehicle. Now."
Fortunately a second officer showed up, one that was not hellbent on giving a ticket at any cost, and was a voice of reason.
The thing that really bugged me was that she was treating me like a criminal. This was the first time I've been pulled over, and interacting with a cop for that matter. She asked me if I had weapons, I said "I have my pocket knife" and I gave it to her. I am a nervous guy, so I put my hands in my pockets; when I did that, she put her hand on her taser and said "SIR! LET ME SEE YOUR HANDS!" She then adminstered two or three sobriety tests that I passed, and at that point she asked if I wanted to take the breathalizer. My response was "What time is it?" she replied "7:30" I said "I have reservations for dinner and me and my friends, visiting from out of town, would like to go".
Furthermore, the thing that really pissed me off, was I specifically asked her "What are the consequences if I do not take the breathalizer?" and she did not tell me. Not one word. So I said "No, I'd like to leave" and she asked me to put my hands behind my back, and which point the other officer that showed up talked some sense into this crazy officer.
Had I known that refusing the breathalizer would have resulted in me getting handcuffed, I would have taken it right off the bat. But to answer your question, I refused to blow into it initially out of principle; people transporting alcohol in their vehicles =/= drunks. If that were the case, you might as well arrest 25% of the people driving out of a grocery store. I had plans for the night, I was not drunk, nor did the little amount of alcohol that was in my bloodstream affect my judgement or abilities.
I normally respect cops and all that, I hate when little kids or teens or whatever come off as arrogant jerks and go "Yeah man the police suck, theyre out to get you." But in this specific scenario I think we had a gung-ho CHP officer that was determined to give me the harshest punishment possible, no matter how obscure, simply because I had alcohol in my possession.
The only defense I can think of is that the area I was in was pretty white trash (lots of alcoholics, meth labs/addicts, etc) and she was just accustomed to dealing with a certain type of people, and apparently aguy with a messy car and a case of Pabst Blue Ribbion and a pocket knife gives her just cause to assume I am that type of person :P
Idunno, maybe I just reminded her of someone in her life that beat/raped her and she was out to get me. Powertripping or something. I dont know.

To answer your question, I got pulled over because my passenger didnt have his seatbelt on (actually I was pulling out of a lot and he was in the process of putting it on...like I said, this cop was determined to give us a ticket).
