Actually, some games have better performance in Vista/DX10. Namely games that were made to support it. CoH had a patch, which is why it is the only DX10 game to have such massive performance downgrades. Lost Planet has better FPS in DX10 mode, and CoJ has 90% of the DX9 FPS or more.
