i lost my OS CD!!!

i lost my CD to reformat. so am i out of luck or could i use another persons OS recovery CD?

depends, it would help if we knew if you are talking about a pre built system such as a laptop or a home built rig.

it was a home built rig....so i have all the driver CD's for the MOBO and what not but i am using the OS from an old prebuilt that doesn't work no more.

You can download the CD online from any torrent site. It's not illegal as long as you use YOUR product key and activate it legally with microsoft.

Why isn't it illegal? Because your buying the license, NOT the CD.

Like the other guy said, get it from ANYWHERE...you have a legal key so your doing nothing wrong.

If you are using the OS from a prebuilt, it is likely an OEM version. OEM versions are tied to the computer they came wit - you may not (according to MS license terms) transfer the OEM version to another computer.

The US Courts declared a day or two ago that purchasers are not buying the license to software, we are buying the SOFTWARE. We can use it on any computer we want how many ever times and we're allowed to sell it, as long as we sell it in it's entirety.

The ruling was about Autocad (Naming Autocad is just a matter of reference. It will, of course, apply to all software)

OEM versions are discounted versions (on the premise that it follows the PC), while retail is another issue. The autocad licenses in question were supposed to have been destroyed (as par of an upgrade rebate) and not resold.

Read the link. Things are a little messy.

It doesn't matter what the ruling was about, that ruling will apply to future case, IE it applies to all software.

And as long as MS has Windows activation, you may resell you OEM version if you wish, but there is no guarantee that the buyer will be able to use it.
