i lost my CD to reformat. so am i out of luck or could i use another persons OS recovery CD?

You can download the CD online from any torrent site. It's not illegal as long as you use YOUR product key and activate it legally with microsoft.
Why isn't it illegal? Because your buying the license, NOT the CD.
If you are using the OS from a prebuilt, it is likely an OEM version. OEM versions are tied to the computer they came wit - you may not (according to MS license terms) transfer the OEM version to another computer.it was a home built rig....so i have all the driver CD's for the MOBO and what not but i am using the OS from an old prebuilt that doesn't work no more.

The US Courts declared a day or two ago that purchasers are not buying the license to software, we are buying the SOFTWARE. We can use it on any computer we want how many ever times and we're allowed to sell it, as long as we sell it in it's entirety.

Yes, I understand that the Autocad ruling is generic. I will modify my post to reflect that. Still, if you read my link, you'll see that not entirely that clear cut. And as long as MS has Windows activation, you may resell you OEM version if you wish, but there is no guarantee that the buyer will be able to use it.
