Game publishers/developers like unreal engine 3 because it is so console friendly. Cryengine 2 will be more widely used once the next generation consoles come out.
Tho I dont think Unreal engine 3 is getting stale. UT3 and Gears of War is just amazing and jaw dropping because of the graphic quality. Had this one guy, who a non gamer, couldnt believe the graphics are really from a game it is so good. Cant wait to what Dragon Age would look like with it being on the same engine.
Too bad it was used in the most craptacular fashion in BioShock. Bad optimisation, unbelievably low-res textures.
But I like in other games, when it's not overdone. UT3 looks awfully kitsch, but at least runs good. GoW, although it's from the same design team, looks awesome, full of details, but not so full to hurt your eyes. Stranglehold is ok... not special, just ok and enough next-gen for me.
On the other hand, in Tiberium, it's the blandest thing in the last few years. Even Quake 4 had more appeal, with awesome design despite the bland colours.
I don't know about you, but to me that engine used in Infernal (an old-school, pretty and repetitive 3rd person shooter) looks very much like UE3, and it's even better optimised.

It's not that it's just console friendly, it's very easy to use compared to other engines.
Yes, it is getting pretty stale.
Im very tired of seeing that damn engine all over the place. Just because coca cola taste good dosnt mean i wanna drink it all the time :)
Plus, even though the visuals that engines makes is impressive its still rather boring. Bioshock is the only game on that engine so far that really impressed me, and thats because of the art work. Gears of war many other unreal engine 3 games look great, but is rather dull to look at because its mostly just grey.
i can see why so many developers use it. i mean wasn't unreal 2 one of the most used engines of last gen? (atleast on consoles) but personaly i would rather they make there own engines that are optimized to take advantage or their game. that's one reason i think some console games are showing so much promise ;MGs4, Killzone 2, REsistance 2. these games seem to be made to work on the PS3 and only the PS3 thus the need to write a game engine that is optimized to the specs of the Cell and RSX(?)
but with the multiple diffrent hardware configs on the PC side i see why they use it. so far U3 has had a decent track record on the PC and i only see it getting better as hardware gets better and developers get more savy with the engine.
p.s. i too would like to see valve make a new Source engine. maybe when HL3 comes out sometime in 2012? (that's only a guess)
The engine is heavy and unfinished, and the support Epic offers its licensees is laughable at best.
Silicon Knights is a smaller development house than the others named in the recent lawsuit, therefore they are affected most by the delays and miscommunication from Epic. The lawsuit has less to do with the Unreal Engine 3 and more to do with how Epic treats their business relationships. Albeit, UE3 is a decent engine for use on the XBox, but in my opinion it fails to compete with the more popular and streamlined Source engine.
Playing online is where you see UE3 start showing its quirks.
