ok well i have a game called Startrek Bridge Commander its about 4 years old and i decided i was going to re install it so i found the disk and when i looked at the back to see how good it was the game has a massive crack comming out from the middle and to about halfway out the disk.

my question is sience i own the game (can take a pic of the CD so you bileve me) can i download it again so i can play it? i only plan on using it myself and wont make eny copies of it (mostly cause my friends dont like startrek)

as far as i know, it's very illegal
but laws are broad and generalising and often don't apply to specific situations - since the chances of you being caught are incredibly slim, ask yourself - what's more important - being law abiding or being right?
moral > legal, imo, if you paid money for it, you own it now and forever - and if you lost your disc, well, in this age of unimaginable world-wide publicly available data storage, the concept of a hard copy is a shade of grey at best
but yeah, asking if it's legal to pirate something you own is a little like asking if it's legal to kill your neighbour because he's a jerk, you may be in the right, but laws are like carpet bombings - allencompassing and indiscriminate

Well i didnt lose the disk. it just has a big ass crack in it that wont let me install it. have you ever cracked youre game?

It's still illegal even if you purchased it in the past. Why? Because technically, you never bought the game itself...You can't actually *own* a game, you bought the disk it was stored on. Since the disk/data you bought is damaged, you would have to buy it again if you wanted to go the legal route.

this thread is heading towards a short drop and a sudden lock, but whatever i may as well answer

i have very little room in my pc area and a bookcase is in the way of my dvd tray (when ejected) so i have to shift my pc over every time i wanna change discs, and this frequently causes loose wires, especially power wires, and that makes me want to kill my lack of space, but that's not possible because space is not killable, so i usually end up just frowing at my NO SIGNAL displaying monitor for 30 seconds before crying myself to sleep

i forgot what i, oh yeah, because changing discs all the time is such a pain, i get no-cd exes for all my single player games - i have also downloaded games i have purchased and later misplaced

Alot of EULA's suggest you've bought the right to play the game on 1 PC at a time.  You don't own the game and the medium it is stored on is irrelevant.  Cracked disc or not, you have the right to play the game.  Download all you want, as long as you don't share the files (while still keeping a copy for yourself).

Alot of EULA's suggest you've bought the right to play the game on 1 PC at a time. You don't own the game and the medium it is stored on is irrelevant. Cracked disc or not, you have the right to play the game. Download all you want, as long as you don't share the files (while still keeping a copy for yourself). selection_7

It's the answer you wanted, but it's wrong, it's illegal to download a game which is not freeware no matter if you own the game or not.

It's the answer you wanted, but it's wrong, it's illegal to download a game which is not freeware no matter if you own the game or not.

Yep.....Morally, you should be able to download the game you bought without any problems. Technically, it's still illegal.

umm well i would go out and buy it but the game has ben discontinued so i cant buy it in stores enymore. and i cant order it online because i dont have a credit card. also i did not put the big ass crack in my CD. when i played it (didnt play it that mutch) i had a CD rom that would spin out of control (for reasons i dont know wyh) and after a month or 2 it started cracking from the inside out. after letting it sit in its case forever sience the thing in the middle is so tight and over time it just cracked to the point to where i couldent install it enymore.



also the compay that developed the game Activision no longer supports this game so i cant get a replacement.

You have no right to call others immoral. If the topic starter is downloading the game directly without any uploading (ie. not using bit torrent) then it is legal. The thread starter asked if it is legal, not if it is moral.

If some guy beat up my sister, it would be morally correct of me to hunt him down and beat him up.  But the law says I cant, and I am not satisfied with the one month of jail time and 20 hours of community service he would get if the law prosecuted him (which is what first-time offenders get).

Download the game, and if you do get in trouble (which can only happen if you upload, not download, the game) just show the judge the disk you have.  There are literally thousands of loopholes in any legal system that a half-assed lawyer knows about.  So, take the risk of downloading it.  In the highly unlikely event that you do get caught, well I guess your risk didnt pay off.  Just get a 300 dollar lawyer and get by.

I mean, if my friend can get caught with 5 pounds of weed, get a lawyer that costs him 800 dollars, and get off with a 40 hour sentence, I seriously think nothing bad will happen to you.

lol ive downloaded quite a few pc games and have never been caught...i dont care whether its moral or not. im sure people still download mp3s and its the exact same thing. bull****..u purchased the game, it dont work, go and download it (if you can find it)

You can download the game but so long as you enter that CD key in (a legitemate one, that is) I think you are safe.

Hey, if you buy a Steam game, you can always download it for free from then on. And it's not like they're producing the game anymore.

The FBI will only come after you for illegally downloading a game if you download it, burn it onto several CD/DVD's and then turn around and sell them for profit and that is a fact.

200,000 dollar fine for selling stolen movies and games I believe but I might be wrong. I heard there was a law introduced that made the penalty far worse then the one mentioned above. Somewhere around a million dollar fine for doing this crime! Not to mention actual jail time.

Yes, if you can find it download it. You have the right to make 1 back up of your software, according to the law, of a game you legally purchased.

Wrong, he bought the rights to play the game And AFAIK you're allowed to make a backup copy of the games you "own" (as long as you're the only one using that copy of course), for situations like this. It's not always the users fault the CD/DVD broke, just look at the starforce: a lot of people have reported broken CD/DVDs when playing starforce protected games. And sometimes CD/DVDs just become unreadable, even though they have been stored as they should As others have said, there's nothing morally wrong with downloading a game that you already bought the rights to play, but it's not legal either In a situation where the company doesn't even make the game anymore, there are not many choices. You can either buy the game used or you can download it. Buying the game used doesn't help the company who made the game anything (some game companies are even trying to make it illegal to buy used games... just look at Valve), while you might end up in the same situation in a few years when your drive can't read the "new used" CD either

You can make a copy of the game, that is correct!

But just because you can't take care of your stuff does not entitle you do torrent/pirate it!

Most of you have no concept of morality.

You relate morality with not getting caught....!!!

Some guy stated if someone he knew was attacked he could not track him down and do the same.

That is also correct!

Thats what laws are for...for the judicial system to do thier job, of course they would be also be lenient if you did, as it happened under duress.

Most of these reponses are just plain idiiotic!

You don't worry about doing it because you don't think you will be caught...maybe not, the internet is a large place.But you guys are the reason I have to deal with Secur-Rom and other anti-piracy crap!

But being moral is knowing what is right and wrong....and taking something you didn't pay for is immoral and illegal.

So what if you already bought it, YOU BROKE IT!.

Just pay for it...old games don't cost that much!

The guy said he couldn't find it...ever heard of E-Bay or Amazon etc?

Well if you live in Canada then anything P2P is legal as long as you don't sell the items you downloaded. This includes Limewire and Bittorrents :D. I love this country.

I'm actually fairly sure that it's legal - as mentioned, you bought the rights to play the game on one PC. That's pretty much it. The part where you'd run into trouble downloading the game is that AFAIK every P2P program has you uploading at some point too, and that action is completely illegal. Taking a friend's CD to install with your legit license (cd-key) shouldn't be illegal, reinstalling with your own non-original backup CD isn't illegal, but uploading any part of the CD to anybody else for any reason is illegal. Against the EULA maybe, but not illegal. That thing doesn't hold much legal teeth anyway, heh. I may be wrong though, I'm going off of vague memory on IP laws in California/US.

It IS legal in terms of console games and ROMS, in which case you're only allowed to play a ROM if you own the real game. Sounds logical to me that it would be the same in this case, but you can never now.

However, you paid for it, and nobody's is ever going to search you for it.

Sorry I know the circumstances are pretty legit sounding, but talking about downloading games on the GS forums are not allowed.

Technically it is indeed illegal as odd as that may sound.

BTW, you should take care in putting a cracked disc in the drive. Once they have a defect like that the chances that they will shatter while spinning up in the drive is pretty high. If is does do that you can damage the drive as well as yourself if the shards start to fly out.

I don't think there are any repair kits for damage like that, but you might take a look on google.
