PvP works like this.. you can flag yourself as PvP or not, which means you can get attacked in open sea combat or not. if you are not flagged w/ open sea combat, then it is just port battles. you can flag and unflag yourself at any port.
If you die, your ship loses a durability point.. the newb ships have 7 but the ships later on have fewer and fewer durability points and the end game ones probably only have 1 or 2 points, so if your ship gets sunk once or twice you have to get a new one. I think the winner gets to take half your cargo, but I cant remember.
I bought the game and the last time I played was the day it was released (I had been playing about a week or two before release). It's fairly interesting and the ship combat is cool, but the rest of the game sucks. Open sea looks terrible, the ports are terrible (you'll know this if you play), the avatar combat is interesting in design but very weak in practice.. it still needs some work and it has huge loopholes. It was just added a few months before the game's release and a large portion of the game is avatar combat, so that's kinda crappy.
Overall I would say the game is a pass.. if you wanna play something like Eve, just play Eve. It's much more fleshed out and I hear the graphics overhaul is pretty nice.
