Sure, MS has a lot more money than Nintendo and Sony, but all three of them can easily afford the same level of attorneys and can all easily swamp the company sueing them in years of litigation if they really wanted to. It's why companies settle, and if this company just wanted a settlement and thought MS was just as liable, they would be attacking them FIRST, not avoiding them. I would say the reason is because MS doesn't violate their patent as directly as Sony, and especially Nintendo.
Either way, this company may get a settlement based on a small technicality in the patent, but I would make a guess that the patent is very vaugely related at all to the technology being used. They will settle for a few million dollars, simply because that's cheaper than their attorney fees.
