A guy broke into my house when I was living with my parents and I crawled out my bedroom window with a golf club and waited behind a bush by my front door. The a$$ clown came out the front door with my dads computer and got a 9 iron in the stomach and a knee to the face. Lights out. Tied his legs up with a garden hose and waited for the cops. Thats when I decided to become a police officer and am one today. I get to do that about once a week now. No golf club though but good foot chases ending in with pepper spray and some idiot crying about how he can't see :cry:

I have a Katana, Wakizashi, Tanto, a Romanian sword (got it for my birthday from a friend), and a Chinese stylesword in my room. Although I've never used them, I would probably do the same if someone was going to rob my house or hurt my family.
Ummm ... protecting the family? from what? instead of scaring off the burglars, or calling the authorietiest first, he stabbed him in the chest. That kid could be spending some time in jail, if the defendant can prove that there wasn't any imminent danger to the kid or his sister. It would be even more bizarre if the burglars counter sue. zidanem9cAre you kidding? He was being robbed! I have 5 swords 3 unsharped 2 of those with pointed tips. A massive blade (sharp) I can hardly weild it. And my favorite a serrated blade sword very light and easy to use.
I think he should be put through rehab, that was absolutely unecessasy to impale a guy in the chest with a friggin samurai sword, too much genjii or ninja gaiden.

unfortunately he is right. I'm hoping the guys had a weapon or something, cuz the kid might be in trouble. Now the law is you have to get out of your house and not hurt the people trying to do harm to you. Isn't it great that idiot hippies make laws now. Where in the world do you live? As long as you don't wound someone in the back, you can do whatever you want to someone trespassing on your property, imminent danger or not. You can't wound them in the back because that means they were trying to get away, thus meaning unnecessary force. I woulda severed the guy's achillies, or his knee cap, but I'm just vindictive like that. more power to the kid, the guy who got stabbed will definitely think twice before trying to rob someone ever again.

And as far as "rapist" theory goes, you need 2 factors to prove anyone that they are guilty; a guilty mind(mens rea) and a guilty act(actus rea)*note to self*Thank my law professor next time. Second point, they didn't know anyone was in the house, thus no intent to rape anyone. Third point, they can charge the boy with a murder intent. He didn't call the authorities, he waited for the thieves to come back and attacked him. He had time to think, and plan out his attack. Furthermore, to go for the chest, instead of other parts, such as an arm contributes to more of that factor. Fourth, they haven't released the age factor of the teenager, because there is a possibility of incarcerating him as an either an adult or a juvenile. Fifth, depending on the state, if the teenager was not a legal age, the parents could be charged with a negligence. In Texas, if someone trespasses on your property, you have every right to defend yourself and your family even if it means killing that person in the process. They are trying to make it to where in your car you can do the same no matter where you are be it the gas station or the mall. Mens rea and actus rea will not even matter because no matter what, the decision will come down to a jury, and I seriously doubt a jury will convict this kid of anything if charges are brought against him. I have taken law classes also so don't tell me I am dumb.

The robbers could not have known they were there, and what would happen if they found out they were? That happened to my best friend and his family, and now they are dead. One of the robbers went into their garage while the other bound them up and were beaten to death with a hammer then had their throats slit. This situation could of played out so much worse or might not have that is the big X factor but personally its better safe than sorry.... The kid acted on his instincts and if the law seeks to punish him for defending property and possibly their lives then I have truly lost faith in this countries legal system.

There are horrible people in this world and most are unpredictable, and in this case I side with the kid 100%.

"In Texas" ... let's not talk about Texas, the State where they just love to put people on death row, and hands off the most capital punishment next to Virginia. Alright? State statutes are different for different states, I hope you learned that in your class. Secondly, I never said it will happen. I gave a possible scenario that could happen. The jury? the 21 year old thief can play the victim easly and can sway away the jury. Mens rea and actus rea was pointed on the fact on "rape" theory made by another user. I don't recall saying that it was a 100% chance that the teenager will be sent to the jail. Hmm the decision will come down to a jury? You are right about Texas. I am actually an opponent of the death penalty and have attended numerous rallies at the Capital to protest it. Texas actually puts more people to death than China per capita. I must agree that, that is a lot. I could go on about capital punishment for days because that has been my main topic for just about every big project or essay I have done in college. I was under the impression that you were defending the criminals and saying that what that boy did was wrong. The boy did not kill either one of the robbers, so I see nothing wrong with what he did. In Texas, that kid could have killed them, and he would have been praised for it more than likely. As for studying law goes, I recently changed my degree for the very fact of how screwed up our justice system is. I want no part of it. I guess our right to trial by jury, just doesn't matter anymore. Is that what you are saying?
Oh, and I wasn't saying you called me dumb. I was just telling you not to call me dumb because a lot of people on these forums like to name call when you oppose what they are saying.
