Sounds like it's the plantiff's fault ... never, ever send your idea to a movie production company, book publisher, game developer, etc. You get into all sorts of problems. Instead, send your resume...get a job there, and then mention your bright idea. Many places specifically ask you not to send them ideas for this reason. The cost of figuring whose idea it was is higher than coming up one by themselves.
Odd that this news is being reported so late...Google doesn't turn up any recent news about it... But I hope it gets thrown out of court...

The two allege that they sent their work to Sony Pictures in 2002. They note that God of War shipped on PS2 in 2005, and David Jaffe said that the game took three years to develop.
