When you take away the consumers' rights to sell and trade used games, you take away a lot of money from the system, and you hurt new IPs.
Many people that buy new games do so with the understanding that they can turn around and sell it if they didn't like the game. Taking away that ability makes for a more wary consumer market. Less people will be willing to shell out $60 for a new game that they can't get any of their money back on, especially new IPs that don't have the benefit of having a franchise name to fall back on.
No one has taken away the right to buy or sell what they want.Online Passes artificially jack up the price of used games with online content. The millions of players who play online are more likely to buy th new game that already has the pass inside, rather than shell out the cash for the used game, then have to pay another $10 to play online, since they could have gotten the new game for the same price.
By artificially jacking up the price of used games, publishers will end up killing the used game market. There's little effective difference between creating a legal monopoly and blatantly making used games illegal to sell and trade.
