After a temporary injunction, a Judge in California permanently blocked an Executive Order from President Trump that would have cut funding from sanctuary cities

A federal judge on Monday permanently blocked President Donald Trump’s executive order to cut funding from cities that limit cooperation with U.S. immigration authorities.

U.S. District Court Judge William Orrick rejected the administration’s argument that the executive order applies only to a relatively small pot of money and said Trump cannot set new conditions on spending approved by Congress.

The judge had previously made the same arguments in a ruling that put a temporary hold on the executive order targeting so-called sanctuary cities. The Trump administration has appealed that decision to the 9th U.S. Circuit Court of Appeals.

A lawyer for the DOJ argued during a hearing before Orrick in April that the executive order applied to only a few grants that would affect less than $1 million for Santa Clara County and possibly no money for San Francisco.

But the judge disagreed, saying in his rulings that the order was written broadly to “reach all federal grants” and potentially jeopardized hundreds of millions of dollars in funding to San Francisco and Santa Clara.

He cited comments by the president and Attorney General Jeff Sessions as evidence that the order was intended to target a wide array of federal funding. And he said the president himself had called it a “weapon” to use against recalcitrant cities.

The Trump administration separately has also moved to withhold one particular law enforcement grant from sanctuary cities, prompting a new round of lawsuits that are pending.

I still dont get how cities can ignore federal law. If that's the case, I'd like to be able to ignore a few laws i dont like. Like **** off, speeding tickets.

state/local authorities are not required to comply with ICE detainment requests

Trump should be OK with this; after all, he is all about state's right, small government, and is presenting himself as a great example by doing nothing. Hell he probably knew this would fail, just wanted to make a superficial effort like "Oh, gee, golly...well at least I tried right supporters?" then he snickers at the chumps that voted for him.

At this rate everyone would be better off if the rust haired tycoon just got impeached already. Trump is a danger to himself and others. And this is proof that he was literally trying to stifle equality just so he could spend more on starting nuclear war.

They aren't ignoring it. But they don't have to do ICE's job either.

I still don't get how not doing the federal government's job for them is the same as ignoring laws.

It does depend on what exactly these cities are doing. They are allowed to be passive in most cases, but there are ways they can step into obstruction territory, and that they can't get away with. I don't know the particulars of these cases so can't say one way or the other. Since this is California we're talking about here, assuming they decide to pursue it, I suspect it will go all the way to the supreme court to be decided.

Luckily, my department offers full 100% cooperation with the Department of Homeland Security and ICE. In fact, in my time working at a correctional facility before patrol, I help facilitate approximately 50+ ICE transfers. There could have been many more, but a las, sometimes the Feds lacked the space or the crimes did not qualify.

Technically speakingif it were possible ICE would have to deport nearly the entirety of US population aside from native americans. So kudos on this city for not letting poor unfortunate people be deported.

The top 1% horde so much wealth while the rest of the nation has to make do with what little they can get, we allowed a soggy cheeto puff to become president, mass shootings are still common and no one is doing a thing to stop it. So yes I know what sovereignty is. This continent had it before europeans came. The natives had leaders who knew how to respect the land they lived on. Even they knew how idiotic it was to build an oil pipeline through a river (leaked already btw).

It's interesting to see the issue of "State's Rights" being flipped: Republicans are supporting the federal government in its enforcement of immigration laws and Democrats are supporting the cities and states that wish to proclaim themselves as "sanctuaries" to protect immigrants.

What would you like clarification on?

Per my department policy, we are *not* allowed to contact the Federal Government to advise on potential citizenship. I *only* contacted the Feds when a ICE detainer was faxed to our department notifying us they were interested in someone within our custody. Although, on some occasions, an employee did not see a detainer on the fax machine and only notified me after the inmate was already released. It happens. Hell, per the Feds, they would only be interested in previously deported individuals or, the obvious, individuals in custody for felonies or previously convicted of a felony. It was very common for fresh arrestees on felonious crimes to bond out, so naturally, ICE agents would like to speak with the individuals before they left our custody. That doesn't mean *each* inmate I gave to the Feds were transferred to be deported. Many times, ICE simply wants to talk to the subjects in regards to their where-abouts and means of contact. Feds have to use their resources wisely within California, there are simply too many illegals, and not enough resources to account for it all.

As for the gifs and memes, it's hard not to laugh at the comedy keyboard warriors provide. Internet is always serious business, mate. ;)

You know what the worst part is about the whole... i dont know... Trump generation of fake libertarians and conservatives? What you just did. This running to "its just a joke bro" or "don't be so serious" when you get backed into a corner after seriously discussing your fascist actions. This incredibly dishonest sprint to "Internet is always serious business" after you brag and praise yourself of committing these real world acts that affect real people within our country. Then instead of even attempting to recognize what you're doing, the fascist actions you're taking, you run to meme's or this nonsense. If you're not interested in having a serious conversation on these topics, go talk about what its like to be a Bronie or speak about how great the last pokemon game was in a pokemon thread, but don't sit here and try to discuss these very serious issues where you take part in being the worst of humanity and then cry "its for the lol's" when you're called out.

@LJS9502_basic: Like I've told you before, sometimes we can sit and waste our time explaining fundamentals or banter with individuals saying we didn't land on the moon, 9/11 was an inside Job, climate change isn't real, etc, but giving credence to posturing and conjecture just isn't in my playbook. I don't mind the comedy.

Per my department policy, we are *not* allowed to contact the Federal Government to advise on potential citizenship. I *only* contacted the Feds when a ICE detainer was faxed to our department notifying us they were interested in someone within our custody. The point is that you could dispel misconceptions especially since you're the one that claimed that your department is in full compliance with ICE and therefore have first hand experience with how ICE operates. Yeah, it's an internet message board, but for those who are on the fence or ignorant on the issue, this doesn't do any favors since one is calling the other a Nazi and the other is just posting memes.

Since when are states required to do the federal government's job? Republicans sure don't want the federal government doing a states job. Another fine example of hypocrisy among Republicans.

I love comedy, im a very comedic person, but what you're doing is absolutely nothing close to comedy. You're trying to have one foot on the authority side and lean on it when you can, then one foot in the "comedy" side (according to you and 12 year olds) and then lean on that foot when you cant defend what you've said. And clearly the fact that multiple people, with very different political views and very different comedic views are telling you this, should tell you that you're doing what is being said and you should stop justifying with it BS.
