Though I haven't played the Harry Potter game, I'm going to go out on a limb here and say that Sly Cooper is probably the vastly better game. I'm not sure if Move or Kinect have a whole lot to do with it.

Neither of the games were made specifically made for the Kinect or Move and one game was a movie cash in while the other is a collection of games that were already good. And don't forget that the move has pretty much been dominating the Move in scores.
