Seems very redonkulous to me but whatever, I think they can reverse if they really want to and I'm happy they're at least thinking about some sweet existing IP"s just laying dormant right now.

Now, there just needs to be at the very least one awesome core Rare game at the launch of Next X and I'll be all. :shock: :D :P

Microsoft denied Killer Instinct trademark because of little-known 7 year old TV show

COMBO BREAKER!

The United States Patent and Trademark Office (USPTO) has refused Microsoft's application for the Killer Instinct trademark because it's held by another company.

That company is Fox, which registered the mark for a crime drama TV series called Killer Instinct.

According to the USPTO, if Microsoft was granted the Killer Instinct trademark it might cause confusion - this despite the TV show running for just one season in 2005.

Trademark Act Section 2(d) bars registration of an applied-for mark that so resembles a registered mark that it is likely that a potential consumer would be confused, mistaken, or deceived as to the source of the goods and/or services of the applicant and registrant," the USPTO said.

Killer Instinct the video game. I had definitely heard of this.

The suggestion that there would be confusion between Killer Instinct the TV show and Killer Instinct the video game sounds silly, but according to the USPTO despite the differences between the two mediums they can be related. It points to games based on TV shows, including Lost and NCIS, as evidence of this. If a Killer Instinct game was released by Microsoft, some might think it related to the Fox TV show, it claimed.

Three months ago Microsoft took the unusual step of announcing it had applied for the Killer Instinct trademark, but it didn't say why.

The announcement set tongues wagging on a potential new game in the fighting series. Does Microsoft plan an Xbox Live Arcade re-release of the original 1994 arcade and SNES fighting game, developed by Rare? Or perhaps an XBLA version of Killer Instinct 2, which released in arcades in 1996, or Killer Instinct Gold, which released on the N64?

Or maybe it's planning a new entry into the series? Killer Instinct 3?

The ball is now in Microsoft's court. It may contest the USPTO's decision if it is serious about obtaining the Killer Instinct mark. Or it could rename the game it's working on

Killer Instinct was published by Midway?PSP107

Killer Instinct is a fighting game developed by Rare and published by Midway and Nintendo. It was released as an arcade game in 1994 and then ported to the Super Nintendo Entertainment System (SNES) and the Game Boy in 1995

I use to have the old Killer Instinct comic book. It's going to be hard for MS to at least win back me as a gamer until they done something with the Rare IPs. I know I am only one person they may not care about, still looking at what they done to games I loved hurts. It's like what Lucas was doing to Star Wars.

? Idiot it says ms had no rights to it. Also not my fault you didn't buy pd0 or nuts and bolts in order to make better sequels. Including the Conner remake.

I think there's more of us than they know but I can't blame them for thinking otherwise based on the core Rare games sales figures early this gen. :cry:

The up-side though is I'm almost certain that now that MS (360) seems much more excepted in the VG scene so well made, AA, AAA core Rare games would sell like hot cakes if offered early next gen - I know I'd be first in line. :D

EDIT: I wanted to add, I think they would be amazed if they released a true, this gen AAAE Banjo Threeie, with the installed base of the 360 right now, it would sell 3-4 mil or more. :shock:

Do it MS, there's still time. :P

My thoughts are that it's probably a good thing :P Unless they were bringing back the old version, I dislike modern fighting games and killer instinct I think needs to to stay on the SNES and Arcades :P

I hope they do. Their decision is complete BS. They can't have the name yet Killer Instinct the game predates the show by 11 years.. WTF ?

And I really hope they make another KI, even if its an XBLA one. The first Killer Instinct on SNES is still my favourite fighting game to date.

What they could have done is make use of the IP. Maybe then the judgement would be different. Now the last game is from 96 and the TV show is more recent.

Really? Because I currently have KI at my disposal and just in 1995, I still just press buttons. I mean I know how to start Orchid's combo I get about a 8-9 hit.

That was the point of the game. Combos were really easy to make and with some character it was even possible with spamming just one move to create ridiculously big combos. But that is also were the combo breaker comes in and combo breakers were also easy to perform. You just needed to know the move of the opponent because if I remember correctly it used a simple RPS mechanic, so if the combo is using low you had to perform a combo breaker with medium or something like that. It was so many years ago I don't fully remember.

That's not fair at all. MS gave Rare free reign and what did they do? Ruined Perfect Dark and made a Banjo game the fans refused to purchase... and Kameo... and Grabbed by the Ghoulies. Take away Miyamoto lording over them and telling them exactly how to make games and their true talent was exposed. Kinect casual garbage is the only thing Rare is good at these days. There are review scores and sales data that back this up. You could make a strong argument that MS not letting Rare touch their old IPs is at least a sign that MS does care about the IP. How many of them do they have to ruin before enough is enough? For some fans, they want Rare to ruin all of them. MS decided to only let them ruin two.

How did MS Rare ruin the 2005 AAAE PDZ?

The 8.5 Banjo N&B is one of the best, unique, creative games this gen, but didn't sell billions and that's Rare's fault?

2005 AAE Kameo is considered awesome by most that played it even if the first time was this year and if not for the clunky swimming parts, likely AAAE.

What about the unique, creative AAE's VP's as well?

GBTG is a old Xbox title so umm yeah, why bring that up "scratches head"

MS / Rare ruined nothing !!

Oh and it's been a very long time since I posted it but I can g'head and find the old, "Stika's List of Rare Don't Suck quote" from long ago where he listed all Rare games from all gens then averaged out showing Rare hasn't done bad at all since leaving Nintendo and in fact, based on scores makes the case in some area's it's done better - Ya gotta clear your head of all the rosy colored nostalgia you, and many have of old Rare. :P

MS really is a joke. At least sony and nintendo make games. I can't see myself buying their next system if there is nothing other than Halo that isn't available on other systems

I've seen a lot of stupidity in this thread but its obvious you didn't even read the article... MS TRIED TO MAINTAIN THE KILLER INSTINCT TRADE MARK AND WERE DENIED....so Microsoft wants to maintain the killer instinct trade mark possibly because they are looking into a new entry in the franchise....your remark to them bring back a game besides halo is blah blah blah ms is a joke...
