so true. I just think, yes it is great that you want to hack your system which renders a warrenty null and void but then to want to also still get service from the company that says if you modify your system we do not have to render you service is the problem. If you want to hack you cannot hack and still be treated just like all the other non hacked systems.This is getting ridiculous :lol:

So if George wins then that would mean that installing CFW on a PS3 in the states would be legal and if Sony shuts you down for having CFW you could sue them?

The issue really boils down to what the folks can do. Geo has done nothing wrong here but his exploit can be used by many to circumvient all kinds of things in the PS3 such as playing on the PSN network without consent, downloading hacked games for free, etc etc. Sadly, the sins of the ladder does not affect Geo... Sony is in a losing fight here.

Oh so the jailbreaking only applies to mobile devices, interesting.FIipModeThere are specific exemptions to the DMCA regarding mobile devices. There are specific exemptions for software and video games as well, but Hotz does not meet the requirements of these exemptions.
Whether he has "done nothing wrong" as some people are quick to suggest, is really a matter for the court to decide, but from what is known there's enough validity in the claim of violation of the DMCA to warrant exploration.
I believe that if hackers are going to get games like ..say SNES games then go ahead. But if your gonna download games like Killzone 3 (When it cmes out) then thats different.
You don't really own the device that you purchased. It's just like you not owning the rights to the games that you buy.

Actually, thats what all these lawasuits have really been fighting and for a while and probably what Sony's lawsuit will strive to fight against as well. The major wins seem to suggest anything you personally purchased and is in your possesion is owned by you and can be manipulated as such... The problem really comes in, do you have the rights to tell everyone else what you manipulated... So far, the rulings on these matters in the US is a yes for many pieces of hardware.. We will see if console hardware falls under that category as well.. At the moment though, sony has a uphill battle to fight with.

They would need to make new hardware to stop it. sales might be slightly affected but at the same time, the 360 and wii has been hacked and cracked for years and are doing just well... It shouldn't be that big of a hit.

Lol then why care?Well the ps3 has had the fame of being hack prove for a bit and system wars members finally get to gloat a bit that ps3 is vulnerable as well... Just a cycle of system wars.. Ps3 is just the last apple to fall from the tree and is in the spotlight right now.

You own the system but you don't own the software that runs on it. With $300, you are basically bought a licence to USE the software along with the hardware. Sony owns the copyrights of software, not you.
They way PSN is setup right now it would be very difficult to block people from PSN. People have been playing on PSN with custom 3.41 firmwares for months now.i5750at4GhzWrong. They used a few different ways around Sonys blocks but they're blocked again. As far as I know You get the choice of playing "backups" or being on the current firmware and on PSN.
I think this whole situation is so overblown (and kinda predictable and boring). This is something that has already occurred on every single other current-gen platform, yet for some odd reason the PS3 hack is the one getting attention.
People forget that the PSP has been hacked to shreds, has lost tons of software revenue, has lost tons of developer support, and yet in 2010 it still got Persona 3, Peace Walker, Monster Hunter 3 (in Japan, this year in West), Valkyria Chronicles 2, Phantasy Star 2, God of War: Ghost of Sparta, and more.
The self respecting hacker getting sued and looking for media coverage. I'm sure if the lawsuit wasn't there he wouldn't have been there.▲ What self respecting hacker would talk to G4? :? ▲

I love how everyone is giving George Hotz credit for hacking the PS3 when really, if im not mistakem, it was the fail0verflow group. All Hotz did was release the private key
They guy won't lose and Sony can't do much about it to the end user. They may own the software, but they do not own the hardware, and hacking the hardware is not illegal, even though pirating is. Since he didn't pirate or even give private keys to the games out, he's safe. Sony will have to sue the next hacker who gains access to the "games private keys" and releases those, since those keys are soley for the purpose of pirating.
Hotz will win, Sony will have to pay his bills. That's my call on this.

fail0verflow discovered the error in sony security BUT Geohotz used a tactic NOT EVEN failover knew about and released the keys.
Both couldnt have happend with each other
and best part is sony is doomed and will lose hundreds of millions of dollars :)

They didn't distribute any Sony software at all, all their software was custom made to run on the hardware (PS3). It may or may even derive from leaked Sony SDK, I've no idea. But the TRO is based predominantly on violation of DMCA, and there's enough validity in the claim to make a case.
But sure, big bad Sony's evil. I'm sure no other company would act to secure it's financial interests in such a situation. I'm sure Microsoft would be sending Hotz giftbaskets and flowers if he gave out critical security information about the 360 and everything would be all sugar and rainbows.

They just want to download content for free that shouldn't be or mess up online games to make themselves feel better.
