Under the first amendment they have the right to free speech. Remember late last year and the whole "Shipped" and "Sold" confusion? I think they simply stepped it up a notch. Everywhere I went yesterday had PS3s up the kazoo and then some. The pnly next-gen console I had trouble finding was the Wii!Tony-Baxter

Wow, there is so much ignorance in your post I have no idea where to start.
1) There is no confusion in the real world about shipped vs sold. Only fanboys seem to fight and argue about this. To the companies themselves, shipped and sold are the same thing. They have sold consoles to retailers and their job is done. There is no way for ANY of the three companies to know how many consumers are buying the console. All they know is how many consoles retailers have ordered.
2) You can't fake the sales numbers. Whether you look at shipped (what SOny/MS/Nintendo release) vs. sold (what NPD releases)...the numbers ALWAYS balance out. Look at what happened last gen with the GC. They had to actually STOP making GCs due to overshipping and lack of demand. Look at what MS did earlier this year with the 360. They shipped a ton and then for the next quarterly statement, they announced only shipping 700,000 world wide. Why? Because if stores have too many, they don't order more which affects future shipments. These numbers always balance out so they can't be "lies". Plus NPS and other companies that track these numbers act as regular checks.
3) Sony made it clear the last time they released their financials that they specifically mean sold when they release numbers.
4) Funny you make a post about your belief that SOny is lying about sales, yet have not made any comment on MS padding their numbers earlier with over shipments.
5) Did you ever think that the consoles on the shelves were there because SOny was smart enough to ensure an adequate supply while the other companies didn't? We already know Nintendo isn't able to make enough to meet demand. We also know MSproduces a steady shipment of consoles every single month and a sudden spike will cause shortages. It has nothing to do with nobody wanting a PS3 and EVERYTHING to do with meeting demand. That is a smart thing.
6) Similar to the last point. How do YOU know how many the stores received? Did you ask? Did you poll stores to find out how many PS3's they sold compared to other consoles? For all you know, in anticipation of the holiday rush PLUS the price drop, stores ordered way more PS3's than other consoles. If that were the case, then the PS3 could outsell the 360 and Wii and still be widely available. Again...meeting demand and ensuring people can buy your console is a good thing.
7) YOu also state the only console you had trouble finding was the Wii. So is MS lying about their sales, which according to the last NPD was about 350,000 ...roughly what the PS3 has sold so far this month. SO is MS lying about their sales since you could find them on shelves? DO you assume it's because nobody wanted them? Or does that faulty logic only apply to Sony.
You know, i have to ask. Do you go to a clothing store, see a bunch of shirts on the rack and say, "that shirt must suck because it isn't sold out"? Do you go to a grocery store and act like NOBODY eatsbread because the bakery is always fully stocked? So then why do you make the ridiculous assumption that because a console isn't totally sold out everywhere, it must be selling poorly.

what?
you mean Sony means shipped, because thats how all three do thier sales numbers.
NPD numbers come from retailers.

NPD numbers come from retailers.
No. I'm pretty sure in SOny's last financial release, they specifically say the numbers they release refers to thenumber of consoles "sold".
But as I said in point one, to the companies sold and shipped is the exact same thing because they have no way of knowing exactly how many consoles each store sells to customers.
I guess I didn't make that point very clear...it still may not be clear. I simply wanted to make the point that Sony uses the term SOLD in their financials, but that means sold to retailers. The confusion is because fanboys hear "sold" and instantly assume that means sold to consumers so the companies are either lying or the number is wrong. I would argue that sold and shipped, whether to customers or retailers, is ALWAYS the same thing. It may not match up at certain months as demand isn't 100% predictable, but it always balances out and we have ways of finding the numbers from companies like NPD.
The constitution doesn't allow huge multi-national companies the right to lie though. There are rules and regulations they have to abide to.

Who's constitution ?
Sony is a Japanese company that can say anything which is why they didn't give exact numbers

As if your first post didn't make it clear you shouldn't be taken seriously, this one certainly did. Sony is publically traded in the US, more specifically the NYSE. In order to do so, as a foreign company, it has to set up a level II ADR, follow SEC guidelines, as well as NYSE. Either way the original person is right, it doesn't matter what country you are from, you can be sued in the US. The constitution's Freedom of speech is not an absolute freedom. It doesn't allow anyone to lie in the name of business. So continue to hate Sony, you're actually giving them a good name because it's obvious everything you are saying is wrong.
"I can't see anyone who would buy a ps3..."
come on guys that's sad. y do you hate the ps3 so much?
the ps3 is awesome, too bad you can't accept that.
look: the xbox 360 is awesome too!!

It's entertaining when people claim that something isn't selling or someone is lying because they "went to a few stores" and saw some in stock.
Honestly, i don't know what these people are thinking. There were 5 Wii's at my Walmart today...they must've stopped selling completely.
