' I will sue MS...they lied -Halo 3 and DMC4 was not 1080p-' !!

A reader of a gaming website -which i usually go to :) - is going to SUE microsoft for "FALSE ADVERTISING" of FULL 1080p in DMC4:

this is the e-mail that he sent to the admin of the site about his desicion to sue..

" Apparently Microsoft is claiming on their website that Devil May Cry 4 is 1080p when it is only 720p and Halo 3 is listed as being 1080p also when in fact, last year it was made clear that it wasn't even 720p. This is blatant false advertising. Go to xbox.com and search DMC4 and Halo 3 and you'll see on the resulting pages their false advertising. Thought you guys could investigate this. I recently bought the DMC4 on Xbox 360 because I thought that it was better. I went to the store and looked at the back of both the PS3 and 360 versions of the game and on the back of the PS3 DMC4 it said it was 720p which is correct and on the back of the 360 version it claimed it was 1080p just like xbox.com states. I bought the 360 version thinking it was better even though I wanted to buy it on PS3 because I feel like the PS3 controller better suits that kind of game. I was conned. Capcom has obviously come out and said that the PS3 and 360 versions run at the same res. I have a feeling that DMC4 and Halo 3 aren't the only games that are being sold as 1080p. I feel so ripped off. I'm going to sue. "

Let's judge whether or not it's 1080p based on how this lawsuit turns out.

If MS wins, there's obviously some merits to it.

If this guy wins, there is obviously something strange going on.

Of course people won't see it like this.

It doesn't say native. :|

The 360 will upscale anything to 1080p, therefore they can indeed say that the game will run on a 1080p television. If it said "native" they would indeed by lying. It doesn't though.

The courts will have to make a decision on what "True-HD" is.

Forcing the courts to weigh in on marketing terms is going to open a can of worms that I don't think any of us want opened.

Ok. Let's assume you are correct and this is false or misleading advertising. What exactly are your damages? How have you been injured? You spent $60 on a game that wasn't what it was held out to be. So you want your $60 back? For $60 you would file a lawsuit?

It never says it plays in those resolutions but is compatable. To many people are sue happy and continue to throw away money over stupid stuff. I am sure there is no way you would sue or find anyone smart to represent you, because it would be thrown away instantly.wooooode

all it means is that the game upscales and looks just as good on your 1080p tv then it would on it's native resolution. if these games didn't upscale to 1080p they would look almost as bad as when you watch regular dvds on your hdtv.WhyuStillAlive

First of all, why would you believe Microsoft?
Second of all, the 360 can barely handle 640P (that's not even HD) because of the limited memory that MS put in it.

You should just buy the DS3 from Play-asia. I have a japanese one and it works on my NA ps3.

well i can do it in all right? i just make it so my ps3 can only output in 1080p and 480i...then pushes all my ps3 games up to 1080p (but you need to change everything back so you can play ps2 games upscaled or whatever it is)

no grounds for any lawsuit here - those are HDTV modes that the game will display in, upscaled or not.

caveat emptor - anyone that buys a game expecting those resolutions to be NATIVE deserves the 'con' they worked themselve into. try doing a bit of research as to what those value mean before posting on your blog about some bs lawsuit, heh.

It's like how they will say a DVD player will play movies in 1080p, it's upscaling a smaller res but it 's still displaying on the TV at 1080p.Ilikemyname420

that's exactly what those numbers on the box mean - good analogy. it means nothing about the source material, it means it's capable of displaying at that resolution upscaled without swicthing to a lower mode (unlike some PS3 games *cough cough*) making your display look trashy.

if any of these pixel counters took 2 minutes to google or visit the games official forums they'd know the native resolution, and maybe they'd stop wasting their time and ours.

I think that Microsoft would rather settle with the alleged plantiff for an undisclosed amount than spend millions of dollars in court. Since out-of-court settlements are confidential, we will never know what the terms of the settlement are. If Microsoft settles this lawsuit without admitting liability, does it mean it lost?
