Sony did something similar after their PSN debacle to try and protect itself from future incidences but there hasn't been an instance where it's been tested. It all depends on the nature of the claim and whether or not the company is trying to quash the ability of the opposing party to bring suit. Putting an arbitration clause in the ToS complicates the legal steps it takes to get a claim in front of a judge but a shrink-wrap agreement like ToS isn't necessarily indicative of a meeting of the minds and clearly indicates unfair positions of bargaining power.
In short, it gets messy but arbitration clauses aren't "catch all" solutions to avoid civil damages. In this case they are meant to make it less convenient for shark-attorneys to come along, propose a massive lawsuit to an already entitled audience, in an effort to coax a quick settlement out of a massive company so they can get a quick payout. I highly question the amount of damages a gaming audience could bring in a civil suit over an issue like the PSN outage. It's already a free service, so how was anybody financially hurt? Publishers may have been hurt, but I'm sure the platform manufacturer would reconcile with them instead of leaving it to the courts (doing that would be an absolute nightmare).
