Wow, a class action lawsuit against microsoft by a small group of disgrunteled gamers and their evidence comes from website articles and gaming magazines, this isn't going to go very far, especally since you can't trust magazine and internet articles because you can't tell if they're lying in order to improve the image of a console/company they like, or to get their 15 seconds of fame.
Don't forget Microsoft isn't the only one who has released defective consoles.
Atari: Remember the Atari 5200's controler, that broke after an hour of game play: No Lawsuit.
Nintendo: The NES/Famicom was released in the US with defective parts. People have actually gotten hurt using the Wii-Mote: No lawsuit
Sony: The PS2 had techincal problems as well, as does the new PSP model, and let's not forget that update that caused some PS3s to meltdown: Once again no lawsuit
Sega: The 32X had plenty of mechanical problems, and some were even incompadible with certain TVs and Genesis models, or could actually damage Genesis Cartridges: Once again No Lawsuit
