Like this cla$$action suit has a chance of winning. But hey, it's America and we're free to sue whomever we want, for whatever reason, and whenever we want. It's the American way.
If my 360 dies.... I think I'll buy a PS3, that's right I said it.

Do not be suprised when and if it does, my friend. I had mine for 10 1/2 months and it was never even moved unless I was dusting. I thought it was fine and would never go out on me, as no console that I have owned ever has, lol. It ran flawlessly until last Saturday night in the middle of a game of Overlord....boom. The game froze and the screen turned red, I thought it was just the game, so I reset the console and what do you know....3 red blinking lights.
Customer service was cool, and I am waiting on my shipping box as we speak so that I can send it in. I am just glad that I have a PS3 as well, and all fanboyishness aside and just to state what should be obvious beyond a shadow of a doubt now....The PS3 is by far the better console, and whether you like it's games or not is irrelevant. It is by far a higher quality product with a superior design. That is a fact that cannot be disputed.
Besides, what good are the games, if you are constantly having to worry about the console itself lemoning out on you because M$ themselves admited that every 360 is a faulty design straight out of the box? Will Halo 3 and Mass Effect be fun for all of the folks having to wait for their console to be repaired, some for the 2nd and even 3rd time? 3 year warranty or not, what more do you need to know? Is it logical to justify that the console is a flawed design just because they give a 3 year warranty? Who wants that kind of a "send it in and wait for repairs" hassle and risk factor on a 400.00 purchase?
However, I do hope that my 360 gets fixed properly and never gives me any more issues, as there are some great exclusives I am looking forward to, but if it fails on me a second time, then I am just going to get it fixed, bundle it with all my games and Ebay it and stick with the PS3 all the way. Love the games, HATE the console.

Funny if you know how the disks get scratched you wouldnt be posting. Dont move the damned console when its on.

true there are alot of stupid people that sue just for money but these people have cases MS knew from a long time that about RROD and the disc scrathing and didn't do anything about it just said it was a small amount of people and shrugged it off. My disc got that circular scratch to...thats only because my baby neice stood on the top of my 360. Surprised it still worked. I think it would be less trouble to buy a disc resurfacer. What exactly are thay gaining from this? Pain and suffering?

No one can say for sure, man. You may not have any issues, but all I am going to say is just do not be shocked if your 360 bites the dust sometime soon. It is no mystery that they are dropping like flies. Why people who have not had it happen yet pretend like they are not worried baffles me.
3 year warranty or not, who wants the hassle and risk of having to ship their 400.00 console off for repairs? And then have the added worry of it happening again? As has been proven time and time again to be the case. Just being a realist here.
