IW was being uncooperative with Treyarch and wanted to sabotage them by releasing a video on the same day as them...

The ex-bosses are accused of being uncooperative regarding the Call of Duty franchise, allegedly refusing to work with Treyarch on a "unified brand".

Activision's lawsuit further touches on the tension between the pair and developer Treyarch, which created Call Of Duty: World at War and Black Ops, stating:

"On the same day that Treyarch released a video trailer promoting a follow-on product - a map pack or downloadable content - designed for players of Treyarch's game Call of Duty: World at War, West and Zampella released a marketing video for Modern Warfare 2 with the purpose of hurting Treyarch's and Activision's marketing efforts.

"Far from being remorseful, West attempted to justify his actions on the grounds that Treyarch had insufficiently coordinated with Infinity Ward by stating: 'We released on the same day as you because we had no clue you were releasing anything. We are not happy about it.'

I like this one.

In Activision's original countersuit against West and Zampella, the publisher accused the two of embarking "on a secret trip by private jet to Northern California, arranged by their Hollywood agent, to meet with the most senior executives of Activision's closest competitor.

Activision really messed up with Infinity Ward. It's not all their fault though. Still I find it so sad that they would sue EA.

I think this is a new age marketting technique. I think Activision is purposely going out of its way to make ppl hate it. Think about it...for instance in Wrestling...Randy Orton is the bad guy but he has a huge following. Hulk Hogan as part of the NWA was the bad guy, but had a huge following. Think of any major villain, they are always popular. There are just as many people who like the joker as those who like batman. Maybe Activision is using a "reverse psychology" type strategy...The more we hate em, the more we keep em in our thoughts....u know what they say, "There is a thin line between love and hate." Who is "they"? The hell if I know! :P

IW pretty much revived the COD franchise and made it the behemoth it is today. Treyarch just copy pastes their work, adds a few lil tweaks and calls it their own. Think about it this way, if MW1 never existed, would COD be as big today? I think not, and im guessing IW wanted to have full control of their baby. Its like if Activision was like "Ok Blizzard, great work on Starcraft 2, Diablo 3 and Cataclysm.....now for the sequels, Treyarch is gonna take over! Don't worry, you have the one after that!" I think Blizzard would be pretty pissed off seeing another dev basically copying their work, adding a few minor things and then calling it their own.

though I like IW, you guys have to remember, we don't know but if you remember Robert Blowing wrote a message to Treyarch to get off MW when trying to compare games. Treyarch claims that MW is broken, and it got Blowing mad. Rivalry always exists even within companies, both parties are at fault clearly. Don't be blinded because they were fired, and they become the good guys.

Treyarch. A lot of people from Gray Matter work there. GM made United Offensive, which COD purists hail as the best COD game. They implemented the level-up system. Then IW took a step back with the COD2 multiplayer and were criticised for it. So they brought back the RPG system for MW.

Also, when IW sold themselves and their brand to Activision they lost the right to do whatever they want with it. It's not like Treyarch is a bully that stole their franchise. COD3 was made in 9 months...

Remember when Treyarch ported Modern Warfare to the Wii, while IW claimed it's impossible? They weren't even allowed to put their logo on it :/ And with United Offensive they helped build the franchise from the start.

How many CoD games are out there anyway? It must be more than 10. IW made 4 and a crappy remake of the first.

(WaW's Soviet campaign is the best COD campaign ever)

So lets get this straight.
IW which was a Activision owned studios I.E they were under the control of Activision...Released marketing videos the same day as Treyarch released marketing videos...and they did this all without the permission of Activision and were never stopped when activision had the capability to do so? and they did this multiple times?

Wait wait....It says they learned the intent from a text message? how is that possible? the court case hasn't gotten far enough yet to have a judge order any side to relinquesh any form of information...so how would Activision know what is in phone text messages? did they steal the phones when they put the offices on lock down before they fired west and Zampella?

Or has one of the few IW employees that stayed behind lied to garner favor?

From my understanding of the case, Acti signed an agreement to give control of the MW brand to IW after the completion of MW2. It would seem at this point both sides were acting shady, but Acti decided to attack the EX IW to hopefully overturn the agreement. I could easily be wrong as the information is rather limited at the moment. Even the article lists that West and Zamp were adamant with EA about how their contracts were still in effect.

So where did these texts come from? How did IW release anything without Acti approval? It all seems rather fishy.

A lot of COD gamers, particularly COD 4 fanboys, were dicks towards Treyarch. But IW is gone and they have Black OPs, suddenly Treyarch is the most awesome dev studio out there.

Because if you read the full extent of claims against IW bosses and the source information, the entire Text conversation wasn't revealed. I would love to read the entire conversion and not those lines cherry picked by Activision.

I'm sure no one likes to share their franchise that they created. It would be like if Bioware had to share Mass Effect with some lesser EA company so games could get churned out faster.

People hate Activision, we get it. Fact is, all the evidence isn't yet known, and you'd have to be quite silly to view either party in this as "innocent."

Quite frankly, both companies continually put out sub par quality products, which consumers have no protections against if they are dissatisfied with. I hope they both get what is coming to them, in all honesty.

They did not become the good guys,Activision did not want to even pay what was rightfully theirs,how is that for greed.? Activision should have threat them better,after all mw wasn't made by Treyarch,they sold like 20 million copies of mw2,they should have pay instead of been greedy. Also broken or not mw2 is 10 more fun than black ops or waw.

I agree with everyone when they say Activision is the scourge of the gaming industry, as they seem to not care when the say something that is insulting to gamers. But all you gamers should look at the fact that Activision is a business and they are entitled to do this, and if everything they have claimed is true, it is insubordiation on EAs part and West and Zampella were in a breach of their contracts and it would look as though Activision would win the case. Even though the claims they are making are completely outrageous and make for great Crime Drama movie material, they do seem to have evidence to support what they are saying, they are not just saying it for hits on gamespot, IGN etc. They are smart business people (not smart when it comes to games though) and wouldn't charge or sue unless they have a chance to win it. They could very well have a case, but I personally want to see IW and EA win this case and make Activision look even worse then they already do...if thats even possible

Activision confiscated all forms of communication as part of their investigation, according to rumors around the time this was first getting out. I'm guessing it was texted on a work phone, and the emails were work emails? I don't know though... Activision still is crossing a line and grasping for straws with this kind of evidence. Those texts don't prove that he maliciously planned to release it on the same day, it sounds like it was a coincidence, and he had no idea, and when he found out; instead of backing down he just said go ahead. It's far different from the picture they want to paint.

So you decided to ignore the half of the story that was the whole point of the story? It was news because Activision filed an expanded action against EA and submitted evidence. Ignoring the evidence would seem to miss the juicy part of the story. And how do you know there is anything more to that part of the texting anyway? Neither of us is in a position to say, but it seems heavily biased to ignore what evidence there is.

You give IW too much credit and Treyarch too little. The former has repeatedly proven that they cannot top their first CoD entry, and were bested within a year by a friggen' expansion pack (made by GreyMatter Studios, which later became *gasp* Treyarch).

Several people have asked this question and I don't know why. Company issued phones/devices. Company servers and network. Nothing you say/type using company assets is private. It is all logged on servers and available to the company. It doesn't even matter if you delete your whole inbox etc. A backed up copy of everything you ever sent/received is on a company server. I thought everyone knew this.

I routinely have my managers or security personnel search through email etc of employees I have been forced to terminate. It is amazing how much sensitive corporate info they send to their friends etc. Heck, we just had a scandal up here in Canada where some low level gov't staffer admitted sending out copies of the proposed federal budget to 5 different firms he was interviewing with....the proposed federal budget which is supposed to be secret until announced. LMAO at the crazy things people do with company email etc.

I think acti would have let the inter company rivalry go on the grounds that competition between their studios improves their product, however from what I understand west/zampella were allegedly meeting with EA, with a view to not only jumping ship from acti but also taking numbers of key personnel with them, I think the important thing to remember is activision would not be drawing the likes of EA into the picture unless they had good cause and more importantly proof of their involvement.
