They say that crime doesn't pay, except that it does – really, really well, in fact – so long as you don't get caught. However, the problem is that you pretty much almost always get caught, as was true for Qiang "Michael" Bi of Ohio when a spreadsheet of illegal sales of pirated software sent from his personal email to his work email was intercepted by…of all people…the FBI. From 2005 to 2009, he had apparently sold 35,000 pirated games using more than 50 eBay and PayPal accounts and leading to charges of "mail fraud, copyright infringement and aggravated identity theft."

The Columbus Dispatch, crime will indeed pay, although the check will be going to the FBI's Cybercrime Task Force. Bi will be lose his home and car, serve a two-year prison sentence and pay more than $367,000 in fines. All of which goes to prove that piracy remains a priority for authorities both local and federal, so be mindful of how and from where you're getting your digital content, folks.

He is mostly in trouble because he sold them, which warrants a much harsher penalty than if he just downloaded them.

I am friends with a guy who sells PS2 and PC games, as well as movies off a stand near a mall. He's a good man, and this is his only way of income.

So he sold 35000 pirated games... I assume console games. For that he loses, his house, his car, gets 2 years in jail and has to pay almost 400k in damages. Ye sounds really reasonable.

I know its certainly not right to do what he did but in the grand scheme of things, 35k is nothing considering its going to be of several different games. I think the penalty he is receiving is adequate, you guys want someone to serve more then 2 years and jail in addition to losing everything he owns simply because he pirated games? Seems excessive to me.

Haha I love reading about this stuff. Im currently in a country where you cant find NON pirated DVDs if you tried. You may be able to find an occasional store that sells a legitimate PS3 game but theres your ceiling. I dont even mean in the its some market or something, the most expensive mall by the Hilton that sells Armani Jackets and several karat Jewelry has a nice big store for the newest Movies, Games and Music.

People have such a high horse about this issue and yet such a limited view as to its implications out side of their little bubble. This man did wrong but do you honestly think this is a fair punishment in a country were Charlee Sheen gets away with snorting coke of a prostitute, trying to beat her up and destroying a hotel room with a warning?

..

Whats even funnier is that I would but my bank account on that 90% of the people on this board have downloaded illegal games, movies and music. Im on my last term of Uni in Canada (in a business school that is in the worlds top 25) and the first thing you are recommended to download when going into first year is DC++. Get the newest of anything in a second, literally youd dl movies in 5 min tops. Man dun goofed, but dont all start playing high and mighty looking down and spitting on him thinking that the average, even amongst yourself is any better. This is pretty clearly not a reasonable way to deal with such an issue (even if he did sell and not just dl)

I know Mac has it.

Super Mario Galaxy, Fallout, ME, Black Ops, everything is there if you want to download it. Tbh, I certainly was uneasy when I literally saw the amount of people who had these games up for dl. since that clearly is not legal. (and no, I haven't dl'd any games)

Not just Mac. Quite literally every big campus in the country has it (or Shakespear which is equivalent). From UBC and UVic till whatever that Uni in Nova Scotia is called (University of Nova Scotia I think). To the best of my knowledge the reason this system survives is because it falls under sharing and was originally intended as just a massive Dropbox like thing. And Western is awesome, shall be sorely missed.

Hey! Catching sleeper cells ain't easy and drug dealers ain't easy! They just do this when they're waiting for something new to investigate! :P

I honestly have no idea what the FBI does exactly, but I'm assuming this is just a byproduct of other investigations in PayPal accounts with high activity but no explained source of income.

Eh, point stands. :P What point? I don't know, but piracy doesn't exactly fall under your local authority's jurisdiction. Gaining access to eBay and PayPal isn't something your average officer can do either as far as I know. No idea how detailed the spreadsheet was, but I imagine that the FBI investigates any suspicious financial activity in the event that persons associated actually happen to be dealers, etc.

I also recall warnings from the FBI in movies to not pirate movies, so I don't think you should be surprised they also cover video game piracy.

Well I know most universities have it but I used mac simply because I have personal experience with that said university (a sibling went there). I actually am curious to this now however, I don't know enough about the sharing and dl'ing side of the law to give any competent response but you'd think given the fact that these companies are all going after used games, they might find a huge problem with university students just downloading all their games openly.

Western is quite the school I must admit, enjoying the first year greatly.

you know, there are countries in which they sell everyday massive amounts of pirated dvd movies, games, pc games, software etc, and the police walks near those stores or sellers and wanna know what? they do nothing about it cause it seems to be normal. funny huh?

The world is funny in a way with a lot of irony.

Indeed. I think people are a little unaware of exactly how common this practice is too. I mean simply put, the distribution channels to certain places in this world absolutely suck. I went to Africa a few years ago and everything is pirated and sold and that is common practice. In the same notion, in in big stores I failed to see any reasonable amount of legitimate software sold. Probably because A) there is barely an money to be made and B) its just not realistic to sell these games at full retail price there.

My country is like that... People do it for a living, it's not like they enjoy it. You know that the average salary here is 240 euros, and one game is 60 euros? Think about that.

I feel sorry for the guy... Having his home taken away is terrible. They could have fined him and gave him a strict warning instead of putting him in jail for 2 years and taking his house and car.

Celebrities and the rich get off charges almost easily and the common man goes through things like this...

Another thing is the fact that the FBI intercepted this. Is there no privacy in America? I'd hate to be watched like this.

People pirate things for all sorts of reasons and I won't judge them because of that because honestly I don't really care, but I don't like the fact that he was selling pirated material.

It's always baffeling to see who rears their head and tries to somehow spin a defense for this kind of stuff. Forget the corporate side of the gaming industry for a moment and put aside the "gonna screw the big wigs like Activision" mentality, and realize that just maybe, other players in the industry like conceptual artists such as myself, or the animators and riggers, environmental designers and texture mappers etc, just perhaps get hurt by piracy also? Think about that the next time you want to justify pirating. You're not just hurting the suites. You're hurting the ones that actually have the passion and put in the hours and hours of work to make the games you enjoy.

I doubt that. I wasn't trying to justify piracy, i was saying that piracy is not some abhorrent crime, and a person selling pirated CD's shouldn't have gotten any jail time. You people act like he deserves a guillotine or something.
